As the daily avalanche of information pours out on the tactics of the FBI and special counsel in their “Russia” investigation –- courtesy not of the Justice Department and mainstream news but of congressional oversight committees, watchdog groups and a few relentless reporters –- we’re learning more about the apparent set-up cooked up to protect Hillary’s candidacy and, later, to hobble and if possible remove Donald Trump.  But there’s something even beyond that travesty we must sadly take away:

There is something seriously wrong with the system of justice in our country.

Sure, we’ve always known our justice system wasn’t perfect, because it’s made up of human beings and nothing about human beings will ever be without its flaws, but we assumed the people at the top were doing their best to ride herd and maintain overall integrity.  We’ve always known there were SOME dirty cops who planted evidence, and SOME prosecutors who cut deals with sleazy witnesses, and SOME defense attorneys who prided themselves in getting the guiltiest and most vile defendants off (hey, it showed how skilled they were), and SOME judges who let personal associations and/or under-the-table money affect their decisions.  We’ve known that the system favored those who had money for bail and high-priced attorneys.  And we’ve had government scandals large and small, in every administration, that dismayed, distracted and sometimes wearied us.

YOU MIGHT ALSO LIKE: White House counsel testifies "fulsomely," as Trump did nothing wrong

But in my lifetime, we’ve never before discovered such a spectacular spider web of contamination.  We see it was the people we should be able to trust the most, the ones who had worked their way to the top, who abused their power and orchestrated what appears to have been an attempted coup.  This mess NEEDED to be exposed, and for that we should thank the election of President Trump.  But it’s sad, and as painful to those who love America as having teeth pulled without novocaine.

We’re watching the system grind people up.  Trump’s national security advisor and retired Gen. Michael Flynn pleaded guilty to lying when his questioners didn’t even think he had.  George Papadopoulos, age 30, a very minor player on the political stage likely used to help set up the investigation of candidate Trump, was induced to accept a plea deal for lying to investigators that would give him a recommended sentence of up to six months in prison.  His wife Simona has gone public, tweeting: “George wasn’t ‘cooperative enough’ in the Mueller’s recommendation.  He cooperated for 1 year and helped his country.  He has been loyal to the truth and not to anyone’s agenda.  His cooperation is considered pointless as it didn’t reveal any wrongdoing by the campaign.”

She says her husband didn’t even have a lawyer when they first talked to him and that he “could not lie, of course, to please Mueller’s agenda.”  She believes the case was “manufactured to justify...the Mueller investigation.”  Tuesday they will meet with lawyers to decide whether or not to withdraw his plea.

We should also be concerned with the rights of some, like Paul Manafort, who may have actually skirted the law sometime in the past because their journey through the system shows how disparate the treatment of lawbreakers can be.  He faces the real possibility of life in prison for not accepting a deal; he apparently had nothing to offer Mueller on Trump.  But Rick Gates got a “sweetheart” deal to testify against Manafort, the person he had also embezzled from, just because Mueller thought Manafort might have something on Trump.  It will be interesting to see what the jury does with this.

But for unequal treatment under the law, who’s been revealed as the poster child for that?  Um, that would be Hillary Clinton.  Thank you, Hillary, for showing us just how messed up our system of justice can get.  You are “Exhibit A,” corrupt but off the hook, the most obvious symptom of the disease.

Commentary continues below advertisement

Contrast her treatment --- kid-glove --- with that of President Trump.  The gloves  Remember when being President didn’t involve constant investigation, horrific accusations (ex-CIA chief John Brennan essentially accused him of treason, and it was said on MSNBC that he would probably like to round people up and murder them), legal hand-tying to prevent him from exercising his most basic constitutional authority as President, and vicious death wishes?   It’s all fine, because...TRUMP.  Justice, reason, and common decency are forgotten.

Obviously, Mueller isn’t through with Trump, and won’t be unless somebody ends this.  White House attorney Don McGahn has already testified for 30 hours about anything they wanted to know, but they need the big fish.  (Read Andrew McCarthy's piece at the link below about why Mueller should go whistle up a rope.)  We now know how “perjury traps” work –- in a nutshell, the prosecutor gets to decide what’s “true” and what’s not –- and Mueller’s goal is no doubt to catch Trump in one.  Otherwise, he’s got nothing.  But what we have going on now has nothing to do with guilt or innocence.  It’s what Harvard law professor Alan Dershowitz has called “the criminalization of political differences.”

That’s what Russian dictator Josef Stalin’s chief of police was referring to when he famously said, “Show me the man, and I’ll show you the crime.”  Folks, this is one reference to “Russia” that we should heed.  Maybe then we can make America’s judicial system great again.

So how do we fix our judicial system? The entire system seems to be failing. When the FBI/DOJ think they are bigger than Congress, we have a constitutional problem. I have never seen such blatant double standard justice. They aren't even trying to hide it anymore, it's like they are putting out a warning to all of those who oppose their opinion. Even Trump won't deal with it directly for fear of being accused of obstruction of justice. Yesterday Jeff Session put out a rebuttal tweet to Trump. It is very disappointing to hear Sessions basically saying "trust me" I've got this handled. Why so vague? Why so secretive? Why no answers to the people's cry for equal Justice? Has the deep state won?

Mr Huckabee, do you see an end to this travesty anytime in the future? I truly appreciate all you do along with people like Mark Levin Sean Hannity, and Tucker Carlson. It cracks me up to watch Tucker debate with the opposition (Far left), he smiles indulgently, and even laughs out loud at their antics. I'm just waiting for someone to really attack him as they have with Hannity.

The federal criminal justice system is corrupt from head to toe and has been for years. Prosecutors lie, cheat, withhold exculpatory evidence. lie under oath and misrepresent the facts to obtain convictions of completely innocent victims. And the judges are just as bad. They, in open court, obviously side with the prosecutor and destroy the defenses of the accused and make ruling contrary to settled law to assist the prosecutor in obtaining convictions against innocent persons. The court of appeals judges are just as bad by issuing rulings contrary to settled law in their own circuits to not overturn lower court judge's rulings. And then the DOJ transfers prosecutors away from their unlawful activity. The FBI is just as bad all the way back to Hoover. The average citizen has no chance in court and sadly to say, juries support the prosecutors rather than make judgements based on the facts. Sadly to say, Mr. Trump cannot change the culture of the DOJ , FBI or drain the swamp within the limited time he can be in office. He doesn't seem to be able to get the current Attorney General to prosecute the criminal behavior of the swamp and politicians that has been exposed nor stop Mueller's criminals from continuing to indite people on completely unrelated authorized investigation charges to put enough pressure on them so they would lie and throw their own wife, mother and grand mothers under the bus to avoid long prison sentences. Cohn being the perfect example. Term limits is the only solution to combat the cash influence of to the swamp. May God give voters the strength and wisdom to same America from the corrupt.

Governor, thank you for your insightful and humorous responses to some of the most heinous acts in our government today! It seems that the Mueller team thinks if they can't find anything on Trump, they'll target anyone who had anything to do with him, and make their lives miserable. (Warnings to his former elementary school teachers!) I think it was C.S. Lewis who wrote that in taking down a leader, you didn't go after him directly but first accused his advisors of giving him bad advice. When they were out of the way, then you could attack the leader. (Mr. Lewis was referring to Christ and his followers, using an analogy from history.)

I enjoyed reading this article on our judicial system. You are 100% right. They should all take a course in Ethics and Morality. Most of the people you mentioned but not all, have been guilty of at least more or more of the seven deadly sins--Pride--Envy--Anger--Sloth--Avarice--Gluttony and Lust. Then we can add Greed, Power, Money, and Status. As you said these are people who we are suppose to have trust in to do their jobs honestly and with due diligence. We need to clean house.

I have a story about being called for jury duty---when I was called for selection I was asked questions--basically my name and occupation--then came one --"Do you have any one in law enforcement?"--I replied to the judge, yes, my two nephews whom I admire. He then asked me if we talk about law enforcement etc. I asked honestly. To my surprise I was left off the jury. I waited for a time out and saw the presiding judge and asked way I couldn't serve. He was very polite and said the lawyers didn't want my type on a jury; they were trying to get their client off. ( He was a thief) What a learning experience that was for me. ( I can not print what I said to him)

We all know the system is broken ,but until Obama got into office it was almost tolerable. Obama filled the courts with liberal judges that would help him implement his moslem agenda and help him to by pass immigration laws. Those judges also go much softer on real criminals and harder on conservative Americans to create more division and crime in our society so he could effect changes in this country without a fight. That is why most polls show the judicial system is in the low double digits today. Why to many judges are in fact criminals themselves as they have forgotten why they are in the job to begin with.

In all of American, by now any fair minded individual can see as plain as day the lawlessness of the Meuller's (so called) investigation. It is like the days of the hanging judge, there is no attempt to try to show any impartiality or fairness, if there was, the investigation would be centered squarely on the Clintons..

You are 100% correct. My wife and I are currently dealing with the same situtation at the local level. Lack of due diligence, NO oversight, and massive corruption abound at the local level. Blank court orders, unfounded charges, convictions with no evidence are common occurrences here. Defense attorneys are suppressed in a court of law. Evidence of collusion and perjury is suppressed. When everyone is in everyone else's back pocket, how does justice prevail? When trusted evidence of crimes committed is suppressed and blessed is lady justice blind or dead? They do as they please because defendants have no recourse and representation is quieted. May seem like a rant but you too would be upset if your son or daughter were fed meals from a trash bag, exposed to both financial and sexual exploitation, exposed to pornography, and recklessly endangered. This is all documented and blessed by our local judicial system. But corrupt elected officials, public servants, and sworn law officers are immune and are empowered to make it up as they go. You can't make this up. When President Trump talked about draining corruption, I have found that a vessel emptied with the drain in the bottom is more efficient than dipping the vessel from the top. Bless you for your moral standings and support Mike Huckabee.

    Thanks for listening,

A very well written article on the injustice in America with our courts and those who continue to dodge the criminal justice system. You are so right that Hillary Clinton truly is exhibit A of someone who has thus far had nothing pursued against her long list of crimes or ethical violations. And of course the list goes on and on from the past administration like James Comey, Eric Holder, Loretta Lynch and so many more. So disheartening and discouraging that America's justice system seems to have come to the point of no justice at all. Reading daily of federal judges and others giving almost no sentence to rapist and other criminals. Mueller's investigation is indeed so obviously slanted towards wanting to take President Trump down. It is beyond me why Mueller is allowed to continue. It is being driven by pure dislike and an agenda to remove Trump from office. We need an Attorney General that has some intestinal fortitude and actually wants to pursue injustice. Draining the deep corrupt swamp that has been exposed by President Trump will be a burdensome task and probably dangerous to the person and persons who actually make the pursuit, but to not do will only reinforce to the American people that it appears our justice system is eroding or at least there is a two tier system, the one for the Clintons, Comey, and others where nothing happens and the other where people are make an example out of via injustice, like General Flynn. God help us !!!!!!!!!!!

Being 71, I’ve heard and seen a lot. But, the magnitude of deception by members of the FBI in this situation (masking as an investigation), is more than I could have ever imagined. It is ridiculous with all the exposed information regarding HRC, that charges still have not been filed against her.
In my opinion, it’s time for this “investigation” to be closed for lack of evidence and the one with evidence begun!!!

This “investigation “ has done nothing but continue to polarize our nation. I’m angry, but have no outlet to try to help the situation. It’s definitely the most frustrating issue of my lifetime.

I will give Obama credit for one thing he got done other than a 100 toxic plans that needed to be cleaned up and shut down made right his crime family so far has not put any of his criminals behind bars when and if they do convict these low life do you remember Gitmo the place the crime boss could not get shut down I think the vacancies can be filled with the boss and his mob the only thing he did was remove criminals so he can replace them with his mob maybe we can deter the bad judgment in our high offices in the future take their freedom and their money assets we can"t cut their tongues for lying or cut their hands for stealing Gitmo geter done

    Dear Mike,
Thank you for laying it out. In my wildest dreams I never imagined our government could be as corrupt, criminal and treasonous as we have seen the Obama administration to be. As gruesome and horrifying that is the real truth is that it is even bigger than that, this is the EXISTENTIAL fight we are in with the globalist socialist elite around the world. When the American people voted President Trump into office we stuck our thumbs in their eyes, they saw 100 years of continually forcing their liberal, open border, socialist ideology going down the drain. They were winning... they have been slowly turning the screws on the American citizen because they know the USA is truly the last and only bastion of people having self governance, the rights of freedom, liberty, and the pursuit of happiness. Until they destroy the USA, they cannot impose their world-wild socialism and take control of every human on earth, telling us what we can and cant do, when we can and cant do, how we will live our lives. Their socialism isnt about taking care of anyone because that has proven to never be able to work time and time again all over the world, their socialism is about control of the population of the world so they can rule over us. It is nothing less than this and the American people must wake up quickly and realize we are this close to losing our liberty, our freedom, our Constitutional Republic to become another defeated, destroyed socialist country where the people have no identity, and no right to self governance. VOTE the liberal democrats out of office at every level of government and do it now and always, or leave your children, your family, your friends to the whim of people like Soros, Hillary Clinton, Obama and the rest of the thugs which have tried and almost succeeded in undermining the will of the people.
I would also like to ask you and everyone and anyone who might read this to go the Convention of States website at and consider signing the pledge and to become part of the soluton to help all Americans take our country back from the political elite who no longer represent us and have allowed all of this to occur. The political elite in Washington DC will not consider the critical amendments we need to undo their stranglehold on power, we must do this through the Convention of States laid out in Article 5 of the US Constitution.
Mike, I would dearly love to see you come out in full support of the Convention of States. Thanks.

You are spot on, and this situation should be disturbing to any American of whatever political persuasion. What I don't understand is why our representatives in congress are not calling out this disgusting situation for what it is. If they really want to consider corruption in our political system, I think they should also investigate our former President, the one who told the Russian President he would have more flexibility after the next election.

Thank you for spotlightlighting what might be the largest criminal enterprise in the United States - the legal and non-justice system. Why must a judge be a lawyer which is not required by our constitution? Non lawyer judges chosen for their integrity with access to computerized case law and sentencing guidelines would help avoid lawyer familiarity with the judge. Further, the job of a prosecutor is not to get a conviction while disregarding the evidence, solely to get their picture in the NYT and a Madison Avenue partnership, it must be to provide justice for the accused! Legal fees for the most part are outrageous and the only recourse when there is a dispute over fees is to go before lawyers in an arbitration hearing. Class action law suits is no less than a license to steal where the class usually gets hot air and the lawyers get millions! When someone will determine the impact on our GDP, it will become apparent why an overhaul of our legal and non-justice system is long overdue and the statute of limitations on lawyer/client fraud be eliminated.

One again your comments are dead-on! As a retired 30 year law enforcement officer, this scheming, scamming, and selling the "truth" to the highest bidder" makes me almost sick to my stomach.
We all know there has always been corruption in our government. It has always been there in some degree or another, but to see the extent of it, and how widespread it is today in what was once the best and most-respected law enforcement agency in the world is appalling. Rogue leadership has transformed the Justice Department into a mafia-like political agency with an agenda of its own.
I believe it is time to "clean house" at the FBI and justice department. The entire upper echelon must go! They would be better off rotating experienced FBI agents through 6 month stints as Director than where we are today. I am not sure how we can restore the rules of law back in our country for all (i.e. Liberty and Justice for all) and restore the people's confidence in our government.

Obviously IMHO the place to start is with severe term limits for members of Congress, and laws that prevent them from taking federal jobs after their terms expire. Justice must be done or else we will become a nation of total lawlessness. We are not far from there now.

Thank you for your daily columns. I enjoyed the interview with your daughter!

    God Bless!

This injustice has been brewing for many years. At the local level lawyers confer and decide fates. Judges do not listen to concerns of abuse until something drastic happens. After telling the courts to put in place a permanent protection order for my child, they gave visitation rights. My daughter was punched in the stomach before something was done. I was immediately told if I followed court orders of Visitation I would be as guilty as my ex husband! Like I would! That was 20 years ago anditjust gets worse. I am grateful to God that he protected us. Although my 84 year old father was beaten up by this man and he was not prosecuted. I am happy we have people like you and Donald Trump, Cathy McMorris Rodgers and other fine people to stem the tide. It is time to fight back. It is time to stand for justice as our beloved Press Secretary stated on your show. Thanks

Agree with you. I think the joint chiefs of staff need to crack down on Muller who is a traitor, and put him through a Marshall court trial. He is attacking the POTUS at a time of terror by the media, illegal aliens, crime syndicates and open violent demonstrations encouraged by a party that has ceased being political and has become radical, even funded by ennemies of the United States.
