THE LATEST NEWS

1. ORAL ARGUMENTS

Today, the Supreme Court will hear oral arguments in Dobbs v. Jackson Women’s Health, which could be the most serious challenge yet to Roe v. Wade, the 1973 decision in which the SCOTUS yanked a right to abortion out of thin air and claimed they found it in the Constitution. Mississippi is defending its law banning abortion after 15 weeks of pregnancy. Here are the details and background:

As expected, protesters from both sides are gathering outside the Supreme Court, and Democrats are falling back on their favorite tactics when they don’t have the facts on their side in a case: threatening the judges and predicting the end of the world if they lose.

Reality check: even if the Court sides 100% with Mississippi, that would still not ban abortion, but just allow states to place certain limits on it. And even if the SCOTUS recognized Roe for the tragic, badly-decided junk decision that it clearly was and threw it out entirely, that would not ban abortion, as pro-abortion advocates imply. It would simply return decisions over that issue to the individual states, where they belong. Some might ban abortion, others would impose no limits, and others would fall in the middle.

Incidentally, I wonder how many very liberal Roe supporters realize how much that decision owed to the precedent of the Dred Scott decision, one of the Court’s most shameful moments, when it reinforced slavery by finding that some human beings can be the property of others because it would inconvenience society too much to grant them human rights? Some fine company you’re keeping there, abortion rights advocates.


2.  CHRIS CUOMO IS SUSPENDED INDEFINITELY: 

Under intense pressure from all sides, CNN finally announced that anchor Chris Cuomo would be “suspended indefinitely” after it came to light that he was more heavily involved in protecting his brother, then-New York Gov. Andrew Cuomo, from sexual harassment charges than he’d admitted. That includes allegedly lying about using his journalistic sources to share intel on the women with his brother’s aides.

Pardon me if I find CNN's action underwhelming. Even liberals at outlets like Rolling Stone and MSNBC said this was such a shocking breach of professional ethics and the public trust that he should be fired and banned from journalism. CNN’s response: he’s “suspended”…”indefinitely.”

“Suspended” ain’t “fired.” And “indefinitely” literally means for no particular set length of time. CNN fired Jeffrey Toobin for exposing himself during a Zoom call. He was back on the air eight months later. If they’re okay with showing viewers that, I guess it won’t be nearly as long before they’ll be showing us Chris Cuomo again.

3. CHECK OUT THIS STORY:

Check out this heartwarming story of how a college student and competitive swimmer was only doing so-so for three years until, in his final year, he began notching up first place trophies and setting new records. What was the secret that finally allowed him to surge into the top levels of the sport? He came out as “trans,” changed his name from Will to “Lia,” and began competing in women's events.

You’ll surely be moved by his (sorry, “her”...or is it "xir?") story about how hard it’s been, but fortunately, “Being trans has not affected my ability to do this sport, and being able to continue is very rewarding.”

Yes, extremely rewarding! Not so much for all the girls who are literally being left in “Lia’s” wake, and who might also have dreamed of winning those titles, only to have their dreams crushed by their new large, muscular competitor. But then, the media can’t defend their right to compete and win in women’s sports. The preferred narrative is almost as important to them as preferred pronouns.


4. VACCINE MANDATE CONTINUES ITS LOSING STREAK:

President Biden’s vaccine mandate is continuing its losing streak. He’s already backed down from imposing it on federal workers (the group over which he arguably has the strongest claim to power), and on Tuesday, his claim to having power to impose it on the private sector suffered a double header loss in courts.

A federal judge in Kentucky blocked the mandate from taking effect against federal contractors and subcontractors in Kentucky, Tennessee and Ohio. He said this case isn’t about whether vaccines are effective (he believes they are) or whether the government can impose vaccine mandates in certain circumstances, which it can. This is about whether Biden has the constitutional authority to impose this particular mandate, and it’s likely he does not.

And a federal judge in Louisiana extended to a nationwide injunction a Missouri federal judge’s block on the mandate for health care workers in 10 states, halting it in all 50 states. In his ruling, Judge Terry Doughty gave the clearest explanation yet for why Biden does not have the power to impose a sweeping mandate that should have been passed by Congress:

“If the separation of powers meant anything to the Constitutional framers, it meant that the three necessary ingredients to deprive a person of liberty or property – the power to make rules, to enforce them, and to judge their violations – could never fall into the same hands…If the executive branch is allowed to usurp the power of the legislative branch to make laws, two of the three powers conferred by our Constitution would be in the same hands. If human nature and history teach anything, it is that civil liberties face grave risks when governments proclaim indefinite states of emergency.”

Boy, can he say that again!

Needless to say, the Biden Administration is ignoring these court rulings and telling employers to continue with the mandate anyway, which means he’s also now usurping the authority of the third branch of government. Or as Democrats would call that if Trump had ever done it: “FASCISM!!”

5. A CLEAR VIOLATION:

Speaking of indefinite states of emergency being used to grab unconstitutional powers, White House press secretary Jen Psaki was asked if Biden would ban unvaccinated people from domestic airline flights. She replied that he “wasn’t taking any options off the table, but he’s going to rely on the advice of his health and medical experts.” And his #1 health “expert” is Dr. Fauci, who said in September that he would support that idea, and “If you want to get on a plane and travel, then you should be vaccinated.”

Obviously, none of these people are constitutional experts (not a surprise), since as Matt Margolis at PJ Media notes, this would be a clear violation of the 14th Amendment. That states that all Americans are citizens of both their states and the USA; they enjoy equal protection under the law; and they can’t be deprived of life, liberty or property without due process of law. That includes the liberty to freely travel from state to state.

Also worth throwing in: this President seems fine with unvaccinated illegal immigrants pouring across the border from Mexico to Texas, but he would ban unvaccinated American citizens from flying from Texas to Florida. I guess he’s afraid they’d get COVID from the viruses left in the plane by all the illegal immigrants he’s flying from Texas to Florida.

6. HIGH PROFILE COURT TRIALS:

Seems as if we’re suddenly in the middle of a blizzard of high profile court trials. The latest that both started on Monday are the New York trial of Ghislaine Maxwell, accused of procuring underage girls for the late wealthy pedophile Jeffrey Epstein; and the Chicago trial of actor Jussie Smollett for “allegedly” arranging a fake hate crime against himself and for lying to police and wasting police resources.

I’m not going to cover these trials every day in detail, since they’re already getting so much media coverage that by the time you get my newsletter, you’ll probably be sick of hearing about them. But if anything really interesting comes out, I’ll pass it along. So here are today’s two big stories, one of which isn’t even a story, really:

In the Smollett case, his attorney made it clear that they plan to pin the entire ridiculous plot on the two Nigerian brothers who say Smollett paid them to help stage the phony racist, homophobic attack on him and blame it on white Trump supporters. He called the brothers “sophisticated, highly intelligent criminals,” as if anyone involved in this farce were sophisticated or highly intelligent. He’d better hope the jurors aren’t.

As Victoria Taft at PJ Media notes, after all his accusations about other people being racist, when it’s time to save himself, Smollett went straight to blaming the black guys.

Meanwhile, the big bombshell non-story in the Maxwell case was Epstein’s former pilot testifying that he saw Donald Trump on Epstein’s private jet one time.

This was treated in some media outlets as a huge “A-HA!” moment, tying Trump to Epstein’s perverted crimes. But all it did was confirm a story that’s been public knowledge for years: Trump used to know Epstein and one time in 1997, he and some other people accepted a ride on Epstein’s jet from Florida to New York when Trump’s plane was undergoing repairs. There are no records of Trump ever flying on it again, much less to Epstein’s private so-called “Pedophile Island.” Trump later cut all contact after Epstein was accused of sexually assaulting a woman at Trump’s Mar-A-Lago resort, and Trump had him thrown out and banned from the premises.

I’ll let you know if the media get equally hysterical over the 26 trips Bill Clinton took on Epstein’s plane.

    Just the usual leftist hypochracy. I personally think infidelity is one of the big sins, but let us note that if Bill preys on an intern in his office, and is notorious for his infidelity, it’s acceptable, but if Trump takes a hop in the plane of a notorious pedophile it’s absolutely horrible. Yes, I think Trump has been adulterous but did you hear anything like that when he was in office? It would most certainly have come out if he did anything. I suspect Melania has set him straight.

    It is time to get back to leaving more things up to the states. Rarely, does one size fit all. It is more Democratic to leave more things up to smaller groups of people, except of course for true civil rights issues, and those things outlined in the Constitution as belonging to the Federal government.

    On the Smollett case and equal protection:

    The evidence seems to show that Smollett manufactured something to make Trump supporters look bad. He is being prosecuted in a rather timely manner.

    On the other hand, "Hillary Clinton & Associates" manufactured something much more extensive to make Trump look bad, and used their made-up story to bash Trump for an extended period. We are still waiting to see whether Hillary and/or any of her key associates will be prosecuted for something pretty much as clear as what Smollett did. Although we are hopeful that the ongoing investigation into Clinton's associates will (eventually) lead to indictments based on appropriate evidence, no one should hold their breath waiting for timely action.

    I believe this is another case of a double standard. Smollett is being prosecuted "right away" because he is black, and not high enough on the "entitled liberal elite" totem pole. Hillary Clinton & co. ARE high enough, so that efforts to go after them are likely to be dropped or at least significantly delayed. So much for equal treatment under the law.

    Thanks for "O Holy Night!!" I was in the 6th grade in a little 2 room School house when my teacher thought that my boy soprano voice should sing this wonderful song. I had never sung a solo and was very nervous. I made it just fine, then went outside and threw up! It has continued to be my favorite, and now at 85 I sing it with acoustic guitar at Senior Living facilities. My cup runneth over.

    I just wanted to thank you for the insight you gave on abortion and alteration of gender on Spicer & Co. this evening. It was so well defined and I could hear it was coming from your heart. I kept watching both Shawn and her and noticed a few lumps in their throats. Prayers for those young people who think they can alter what God made and that it will have no effects. It will and it does. Thank you for pointing this out. God bless.

    If the vaccine mandate is being blocked, does this mean all the unvaccinated people, that were fired, will be returning to their jobs? They should be, but they most likely won't be.
