Over the weekend, legal eagle Andrew McCarthy had a column in NATIONAL REVIEW outlining the ways a sit-down between President Trump and special counsel Robert Mueller might go. Even though Trump considers himself to be completely innocent of the accusations of collusion with Russia, as well as obstruction or even the intent to obstruct, the prosecutor will still construct a trap. Mueller might not obtain anything that would stand up in a court of law, but he doesn’t need to. if his goal is Trump’s impeachment by Congress, and the Democrats win the midterms, he hardly has to give them anything at all. The drop of a hat will do it.

For example, in a court of law, a charge of obstruction is supposed to be predicated on illegal acts, or at least criminal intent. So far, there is no crime and no evidence of criminal intent. But McCarthy uses the thorny issue of exactly why Comey was fired to illustrate how skilled interrogators can lead an innocent person to become evasive. Though it seems obvious that Trump was mostly upset by Comey’s refusal to state publicly that he wasn’t the target of an investigation, his comments have been all over the map, and a viper, I mean experienced questioner, like Mueller would know just how to corner him. (One point McCarthy doesn’t stress, however, is that Trump wouldn’t HAVE to answer questions about actions taken that are within his power as President. He doesn’t have to justify such actions, and surely his lawyer will have supplied him with chapter and verse of the pertinent law to offer Mueller if and when the time comes.)

At the time McCarthy wrote this column, Mueller had just announced that the President was not a target of his investigation at this point (operative words: “at this point”). Hearing this no doubt made Trump feel relieved and even more eager to talk to Mueller and put an end to the legal mess. But doing so would not end it; it would most likely do the opposite, raising more issues and laying the legal groundwork for charges such as making false statements.

No less a legal mind than Alan Dershowitz has said it’s possible to tell the truth and still be charged with perjury. The arbiter on that will be Mueller; if Trump says something that’s even the slightest bit different from someone else’s testimony, Mueller gets to decide which version is the truth and who is lying. McCarthy reminds us that Mueller charged Michael Flynn with making false statements even though his interrogators said they thought he was being truthful.

If they can’t get him on perjury, they’ll go for corrupt intent. They’ll try to establish that the President’s description of his thought process can’t be trusted on any given issue, because he’s just all over the place. They’ll point out the inconsistent things he’s said (and tweeted) about Comey. They’ll maintain that Trump fired Comey because of the Russia investigation but that he just won’t admit it. Again, this might not prove obstruction in a court of law, but Mueller doesn’t have to do that, at least if he gets a Democratic Congress. They’ll take it from there. And, as McCarthy says, they’ll define obstruction with “a certain elasticity.”

McCarthy warns of what Trump is dealing with: “I am here to tell you that these lawyers are ruthlessly competent. Yes, Trump has been in a lot of litigation, and he has sat for many a deposition. But he has not climbed into the ring with this breed of adversary before, not with this kind of jeopardy at stake.”

VOTE NOW:  Do you think it is time for President Trump to fire Robert Mueller? VOTE HERE

--------------------------------------------------

Anyone who doubts Mueller’s ferocity need only look at what he did on Monday, after McCarthy's column was in the can. He coordinated with the U.S. attorney for the southern district of New York to conduct raids on the property of Trump’s personal lawyer –- that’s RAIDS, plural; one on his office, one on his residence, and one on a hotel room. Attorney-client privilege be damned; Mueller appears to have taken whatever he wanted. This shocking action seems to have crossed a line into a kind of war. The bar is extremely high for this kind of behavior, which apparently occurred with the blessing of Deputy Attorney General Rod Rosenstein, who should have recused himself from this case at the start.VOT

Perhaps this was Mueller’s attempt to goad Trump into firing him. If Democrats take Congress in November, firing Mueller will put Trump on board the impeachment train just as easily as anything Mueller could have charged him with. I have a feeling Mueller would gladly make that sacrifice.

UPDATE: After the (count ‘em) three raids were carried out on Trump attorney Michael Cohen, Andrew McCarthy wrote an update that breaks down the “collusion” –- good word in this context –- between Robert Mueller’s team, the DOJ and the U.S. Attorney’s office for the Southern District of New York, which actually did the raiding. It also addresses the stunning legal double standard regarding campaign contributions:

President Obama easily settled a claim that his campaign had hid the sources of nearly $2 million in large donations and accepted more than $1.3 million in illegal contributions, while Trump is mired in a likely Constitutional crisis and the threat of impeachment over one payment of $130,000 that may or may not even be considered a campaign contribution.

As McCarthy points out, “...what was not a crime in the Obama days is the crime of the century now.”

Best to read the whole thing…

The only reason I don't think Trump should fire Mueller is that is exactly what the false news folks have been reporting already and would just add fuel to the fire. Surely to goodness there is someone else who could do the job and get rid of him once and for all!!! If not he will just keep on and try his best to get rid of the best president we have had in years!!! We are sick of our tax dollars being spent for such nonsense- spend them on getting Hillary convicted- thats where all the trouble with Russia started in the first place

How does Hillary get a free ride by rigging the nomination and her/his foundation paying for a false dossier....no one from the AG's office to the public's knowledge is aware of any proceedings against her or associates whether up or down. It seems if one is a democrat anything (almost) can be swept under the rug and no one rarely yelps but if one is a republican they scream bloody murder if they get wind that jay walking occurred.

"As disruptive as installing a sun roof in Dracula’s Castle"...good one, Governor! The Lord must be on our side...getting a chance to replace a flaming liberal with a conservative judge in the Ninth Circuit! Now that doesn't happen everyday. We all need to pray for whomever President Trump places in that position. He's certainly going to need it.

Now there will be a revolution, Conservatives against all others....to get RID of the corrupt liberal lawyers..... So it seems like President Trump is in a no win situation.... what can we do to make sure HE STAYS A WINNER! How do we know the mid-term elections aren't already tampered with? Especially in New York State where the most corrupt state govt. lives and works in...aside from California that is... Even if President Trump somehow gets impeached, there is Mike Pence, who is more Conservative than President Trump too. God help us! We still need God's help to continue His Good Work by President Trump getting elected....

Muller wants Trump to fire him! Muller has nothing and a firing would make him look good and he would not have to answer why he spent so much money on nothing based on fraud. The firing would also cause the libs to call for impeachment for obstruction of justice...

President Trump needs to defend the Office for his sake and that of future presidents. If he gives in, Mueller will do what you stated: He'll trap the President for any thing that conflicts with the subpoenaed information he's already collected.

It's disgusting to hear that Rosenstein signed off on the recent raid. But what else is new?!? The fact that Mueller came back to Rosenstein for "permission" to raid Manafort's house weeks afterwards is a travesty of justice! Where's the outrage over that?!?

With Rosenstein giving Mueller a blank slate, Mueller's witch hunt continues to find anything to hold over President Trump. The facts are Rosenstein was supposed to instruct Mueller on which alleged violations to investigate. He didn't and so Mueller goes wherever he wants wasting taxpayer money. Where's the outrage over that?!? Instead the MSM does its typical snow job of diversion and wants to focus on something that allegedly happened 12 years ago? Are you kidding me?!?

I pray this November the American people who voted for President Trump will elect the right people who will support our President. If not, the USA will be in a bigger mess and the Deep State will continue with their corruption.

It is said it would be a disaster for President Trump if he fires Mueller (although Mueller definitely deserves it ) because it would end with impeachment of President Trump from the other party. It is also said Rosenstein and Wray can be impeached. I am supporting
the latter 100%. They are stonewalling on all requests of Congress so I am concerned that Rosenstein and Wray are not impeached
    as of yet.

Thank you for this information. Although the information is difficult, Mr Trump is our concern. My husband and I believe now that our God must step in and be the Judge. Mr Trump is doing all that was asked of him and God has put him there for a purpose. Our prayer is that this legal stuff will end soon by God's intervention. He can, you know, be very quick and be the Great Judge. We are so disappointed in these people who have their best interest forefront instead of keeping America safe and on track. Thank you for the opportunity to comment.

I'm not legally inclined as to this and that, but I believe it would be just as mentioned... a trap. they are looking for any "crumb" to jump and down and scream for impeachment. I firmly believe that is "their" plan. If there is some other way to get rid of Mueller I would do that, maybe something along the lines of wasted taxpayer monies with this witch hunt. Nothing is found, this just cant continue as long as Trump is president. Why is nothing being done about the illegal actions they are finding on others besides Trump, like Clinton and company?

Mr Huckabee, I fear for out country that the day is coming when the you know what hits the fan. This is getting beyond ridiculous how "they" don't have to follow the rule of law and get away with what they do, but if "we" so much as spit on the side walk... they make like the its the end of the world. What they continuously accuse others of doing is just what they are doing themselves. Does not everyone see this? I will continue to pray

If you interfere with a cop you WILL go to jail, so what gives a person the right to interfere with the President of The United States a special right to interfere with our president ? There are a lot of people that do their best to stop our president at every turn, if they want to act in a way that hinders our president than they should go to jail, or be fired with no pension.

  • William Schlumpf

    04/11/2018 11:45 AM

Dont fire Mueller. It's a trap. The Democrats would have a field day with the media fanning the flames and Dan Rather steering the narrative to an equivalent of the Saturday Night Massacre. The damage is already done and if anyone is to be fired it would have to be Jeff Sessions. A new Attorney Gen could call Mueller in, and if he is running off on tangents as it appears, tell him to wrap things up and issue a final report or be fired. Mueller is a dangerous man. He bungled investigations in the California office, kept four innocent men in jail while in Massachusetts in some sort of arrangement with Whitey Bolger and destroyed another innocent man (and wasted alot of government money), Stephen Hatfill when he accused him of being involved in the anthrax murders.
It's too late now. We need a new AG to reign Mueller in.

And remember,Pray for President Trump and our nation every day folks. This battle is far from over. Gov Huckabee, I'm so worried! But then I'm good at worrying even though I pray daily (and almost constantly) for President Trump and our country. If the Dems succeed in impeaching President Trump I think there will be a big uprising from all of us who voted for him. I can't believe how far this "left" will go to put our President down. I am 80 years old and can't remember anything like this happening in our government before. I am just going to have to TRUST GOD to save our beautiful America. We are experiencing history in the making.

Mueller is waiting for Trump to fire him so demoncrats can gloat and say Trump went too far and had something to hide...what a mixed up screwed up affair this has been , ALL BECAUSE THEY DIDN'T GET TO ADVANCE THE NEW WORLD ORDER BY ELECTING HILLARY THE THIEF,LIAR, AND COMMANDER IN CHIEF

He can't fire him but McConnell and Ryan better get off their butts and do something. ENOUGH is ENOUGH Rosenstein is not going to do anything because him and Wray are up to their necks in the swamp along with Mueller. (but the again so is McConnell and Ryan). Then when Mueller is gone Trump can really clean house and get rid of Session, Rosenstein and Wray. Hopefully he won't be stupid enough to put ANYONE in their place that has ANY connection to Obama, Clinton or the Bush's.

I don't know why Mueller was hired in the first place. I think we all need to be concerned about client/attorney confidences, if the FBI can just march in and take over. And the Russian probe has been a huge waste of taxpayers' money. I never saw ads on Facebook and the Russian's had nothing to do with my vote for Trump. It had to do with everything that seems to be happening, today, in Congress and the Federal Government.

  • Jim Gaskins

    04/11/2018 08:09 AM

The team involved with this circus act of an investigation, led by Mueller himself, has run straight into dangerous territory. It seems unlikely that anything they’ll recover from these raids will be usable in a court, as it’d be a violation of attorney-client privelege, and therefore couldn’t lead to any legitimate legal action against the President. This is a bolder move, and one designed to start a fire rather than further anything like a legitimate investigation. If they attempt to carry this too far, and push toward impeachment based off of this frivolous and probably illegally obtained information, they’re going to have a very serious problem with the American people. It’s things like this that cause armed uprisings. Don’t think that can’t happen here. Thanks for your posts, Governor.

  • Gail Irons

Governor, Robert Mueller should never have been hired and Jeff Sessions should never have recused himself. This modern-day witch hunt is way out of line. Robert Mueller has gone beyond the scope of what he has been hired to do. There is no collusion on the part of the Donald Trump, however, there is more than enough evidence indicating collusion on the part of Hillary Clinton, yet no one wants to prosecute her and her cronies, up to and including Obama.

Don't fire the ass. Much better take the initiative and hire a new special prosecutor to bare all the political crimes of the last two years. I fear that firing is going to give progressives the mantra they so desperately want to win in November--which may well trigger all out rebellion accross the nation. Don't play into their hands!

I am sick and tired of the treatment our duly elected President is getting from the Dems, Rinos, and media. I think that is Mueller's plan to take this into the fall primary, hoping the Dems take the house and impeachment proceedings. Rosenstein & Sessions must go now along with top leaders in FBI & DOJ. Everyone says that Trump should not fire anyone now, but I think It maybe better for cleaning the swamp if Trump blows the lid off all this corruption now. I just pray that God is still behind our once great Country. If Trump gets reelected, he can really sake things up for nothing to loose and a Country to save. We need a big change in Congress to get the corruption removed. I only have confidence in the Freedom Caucus.

Mike, I voted before to fire Mueller but I want to change my vote to no. In listening to the experts they say talking to Mueller is a trap for President Trump. They say all this is hoping the people will vote democrat and if we lose the House they will impeach President Trump. This is so awful. His mandate was Russian collusion but because they can’t find any they are looking for another way to basically hurt this president which in turn hurts America and the American people. So much hate in our country. We need a great revival and return to God.
On another note. I listen to you and trust what you say. I know you love Jesus so I trust you.

Mueller needs fired. Now. Everyone is talking about how going him would be a trap. It's not a trap? The removal needs to be for incompetence. That way, there is and can be no obstruction of justice. Second, Rosenstein and Sessions need to go. They have been derelict in performing their duties and living up to their responsible. And by refusing or otherwise failing to investigate and prosecute crimes committed by Hillary Clinton, Barack Obama, and their cronies they have aided and abetted criminal activity. They need died. And they need arrested for their crimes.

I think Mueller should be fired, I just don't think Trump should do the firing. I think Rod Rosenstein should be forced to fire Mueller or be fired himself. Rosenstein has played an excellent "Benedict Arnold" in this travesty of justice. If not for Rosenstein's memo, Trump would not have fired Comey. The deep state needed an incident so they could get a special council. They are all guilty of treason.

Firing Mueller would lead to impeachment. He needs to cut off the heads of a two headed snake. Firing Sessions and Rosenstein and appointing a new Attorney General would reign in Mueller, and possibly bring criminal charges on Mueller, Rosenstein, Comey, and McCabe. If he does it, Mueller would run and hide.

Get a new Attorney General President Trump ! Sessions has been a total nonfunctional embarrassment as attorney general and will go down in history as a man thinking only of himself not doing what was best for the administration and the country. An obvious ineffective anchor around Pres. Trump's administration to see investigations done in a proper manner overseen by an independent, honorable AG . In my opinion Sessions has no personal honor as he knew he was potentially going to have to recuse himself from any involvement because of the Russian investigation looming at the time. He should have respectfully declined the appointment. Shameful Sessions should be fired along with Rosenstein who is up to his eyeballs with collusion in the whole mess . Maybe then this Investigation could move along with a new competent AG and closure.

I would like to think that Trump has something up his sleve because recent history has show that Trump can hang in when needed, but being from MA I am sick and tired of hearing it from the left wing looneys and feel like something big needs to happen good for Trump...like Hillary getting indicted or Muller and all the Uranium one co-conspirators. We conservatives in MA feel like we are fighting alone and need our fellow conservatives to show the lefty’s that they will not ruin Trump and our constitution.

The reason why Trump shouldn't fire Mueller is exactly what you said - if he does that, he will definitely be brought up on impeachment charges. Far harder to do, but the better thing, would be to wait until after the midterms are over. If we keep control of the House and Senate, then he can fire Mueller. If we lose either one, or both, of these, then they will press for impeachment no matter what.
The days of attorney/client privilege are over. If they can do this to Trump, they won't hesitate to do this to us poor, unprivileged deplorables. This doesn't look good at all!!

  • Evelyn Kubanka

    04/10/2018 07:31 PM

Reporters are saying that if Mueller is fired the investigation would not be over but rather start anew. I think that Rosenstein is the one who should be removed because of conflict of interests Rosenstein has with all of this investigation. First, he told the President that Comey should be fired, and Comey is a friend. He then started the Special Counsel based on so called Russia collusion, even though he knows collusion isn't a crime and you need to have evidence of a crime to call a special counsel. Rosenstein, Mueller and Weissmann were involved in the investigation of the Russian operatives who were working on the Uranium One deal and they didn't arrest them when they were going to because they didn't want the Press to know that Clinton signed off on it. So instead of going through with the arrests, they waited and the deal was finalized. Then Rosenstein's Wife is an attorney, Lisa Barsunian (sp?), that worked on stopping FOIA requests for Obama 40 times, the Clinton's approximately 47 times, Sebilius 16 times and Mueller 3 times, defending them against organizations like Judicial Watch. This information Dick Morris has reported on and he has credible sources since he did work for President Clinton's administration. The nail in his coffin that he has to leave is he signed off on the FISA warrant and we know that was all started on the democratic paid phony dossier. I think someone who can reach the millions of Trump supporters should start a petition that requires the Special Counsel to provide data on how much tax payer dollars were spent thus far, how much on Russia collusion and how much on other areas they opened up to investigate in search of a crime; also whether or not they have found anything on Russia collusion and if so provide it to Congress and the American people. Then the petition should demand that the special counsel should be shut down because it was started on the false pretext of a crime, collusion isn't a crime. It should also state that it is against our liberties for any government agencies, such as the FBI and DOJ, to weaponize their department for political purposes as is obvious in this case. We should also demand that everyone involved with pushing this phony investigation of a non crime, where there is no evidence after a year and a half, must pay the tax payers back for the money spent on the tangents they went off on to search for a crime they want to stick onto our duly elected President. We have a right to demand that this all come to an end if they can't produce any legitimate, not created documents like the dossier, evidence. Also we demand a grand jury be impaneled for the crimes we know there is evidence of, i.e. Clinton's emails, Clinton Foundation, leaking of information (Comey to his professor friend) and conspiracy to mislead the American people to oust our duly elected President. I sure would sign that petition.

I am still at a loss at, how Trump's attorney's residence, office, hotel room can be raided, how Manafort's residence could be raided, but there wasn't any move to raid lerner in the IRS scandal, or hilary in her scandals? And, now, where is a raid on FBI and/or DOJ offices to obtain information being subpoenaed? And, in Cohen's case--which doesn't have anything to do with Russian collusion, so shouldn't fall under anything mueller is in charge of--was he presented with a subpoena to deliver certain documents? And, I guess in the case of high ranking officials, the client/attorney privilege doesn't count for anything. I sure wish the (what I would certainly place in the illegal category) shinanigans of mueller and the porn star's attorney (wonder who is paying his bill? Soros? hilary? hmmm) would get to the eyes and ears of all Americans, but there are millions who still think the blond guy with the tingly legs and the black haired gal Rachel and the staltzer guy are the only ones to listen to. You would think they would wonder why there is no news about what HAS been accomplished in this Administration so far, but I guess, if they really wanted to face the truth, they would google it. In addition to Democrats and RINO's, there are actual conservative Republicans who have their panties in a wad that a regular politician is not President (but, let's ignore the fact that that is one of the reasons so many people voted for Trump) and are as obstructive as any of the other groups. Shame on them!!!

I am sick and tired of the double standard that is going on in our country. There is HUGE corruption in both the FBI, the DOJ and in Washington DC!!! I wonder if it will be able to be straightened out. Mr. Rosenstein recommended that President Trump fire Comey (I wonder if he had an agenda with that recommendation). After President Trump followed the recommendations of "people he trusted" he has been "thrown under the bus". The first person to be fired should be Mr. Rosenstein (Mr. Rosenstain allowed President Trump's attorney's office, hotel room and home to be searched by the FBI-this is outrageous). I believe that President Trump is "between a Rock and A Hard Place" and not matter what he does or does not do it will "come back to bite him". This is unbelievable and I AM APPALLED!!!!

While I hate what Mueller did yesterday, I don't think firing him would be good for the President. The one he needs to fire is Jeff Sessions. President Trump needs an Attorney General and Sessions is clearly not it. The let the new Attorney General fire Rosenstein. And Chuckie Schumer needs to shut his stupid mouth. Talking about the rule of law that doesn't exist in this country for Democrats.

Muelleran is protecting the enemies of our government, and therefore of our country. He has morphed all over the map away from the one investigation assignment he was given - Trump's involvement with Russia. That was the "nothing Burger" that Pres. Trump said it would be. Mueller is not a Republican with whom I can identify. Enough is enough. Mueller has bided the necessary time needed to try to divert the attention from the true criminals: Hillary, Obama, Lynch, Rice, COMEY, and all the minions of the corrupt government "Swamp" and all the FBI corruption. Mueller was unnecessary when he was hired to investigate, and he is simply a rat hole that we are pouring money down when we need a Wall, Puerto Rico needs help to recover, our veterans (the true heros) have a huge amount of needs, our infrastructure is waiting and bridges continue to rust, and our immigration law andorder still needs the focus of our President. Instead he is being cajoled to deal with the foolishness of Mueller's treasure hunt that is Ending up to be the elephant in the "good politics" room in our government. Mueller was plunked into the spotlight of our National Government as if he was more powerful than our President.

Commentary continues below advertisement

McCarthy warns of what Trump is dealing with: “I am here to tell you that these lawyers are ruthlessly competent. Yes, Trump has been in a lot of litigation, and he has sat for many a deposition. But he has not climbed into the ring with this breed of adversary before, not with this kind of jeopardy at stake.”

-------------------------------------------

  • Cef Coles

If the Dems succeed in impeaching President Trump I think there will be a big uprising from all of us who voted for him. I can't believe how far this "left" will go to put our President down.

    04/11/2018 07:47 AM

The left is dying for Trump to fire Mueller so they can pin him with obstruction of justice. We need to pray for a turn of events to stop this evil from continuing. Hillary is guilty of all they accuse Trump of doing and then some.

This has gone too far. Fire Mueller. Russia Russia was the focus not everything else. The cost saviungs should be applied to the debt.
