Over the weekend, legal eagle Andrew McCarthy had a column in NATIONAL REVIEW outlining the ways a sit-down between President Trump and special counsel Robert Mueller might go. Even though Trump considers himself to be completely innocent of the accusations of collusion with Russia, as well as obstruction or even the intent to obstruct, the prosecutor will still construct a trap. Mueller might not obtain anything that would stand up in a court of law, but he doesn’t need to. if his goal is Trump’s impeachment by Congress, and the Democrats win the midterms, he hardly has to give them anything at all. The drop of a hat will do it.

For example, in a court of law, a charge of obstruction is supposed to be predicated on illegal acts, or at least criminal intent. So far, there is no crime and no evidence of criminal intent. But McCarthy uses the thorny issue of exactly why Comey was fired to illustrate how skilled interrogators can lead an innocent person to become evasive. Though it seems obvious that Trump was mostly upset by Comey’s refusal to state publicly that he wasn’t the target of an investigation, his comments have been all over the map, and a viper, I mean experienced questioner, like Mueller would know just how to corner him. (One point McCarthy doesn’t stress, however, is that Trump wouldn’t HAVE to answer questions about actions taken that are within his power as President. He doesn’t have to justify such actions, and surely his lawyer will have supplied him with chapter and verse of the pertinent law to offer Mueller if and when the time comes.)

At the time McCarthy wrote this column, Mueller had just announced that the President was not a target of his investigation at this point (operative words: “at this point”). Hearing this no doubt made Trump feel relieved and even more eager to talk to Mueller and put an end to the legal mess. But doing so would not end it; it would most likely do the opposite, raising more issues and laying the legal groundwork for charges such as making false statements.

No less a legal mind than Alan Dershowitz has said it’s possible to tell the truth and still be charged with perjury. The arbiter on that will be Mueller; if Trump says something that’s even the slightest bit different from someone else’s testimony, Mueller gets to decide which version is the truth and who is lying. McCarthy reminds us that Mueller charged Michael Flynn with making false statements even though his interrogators said they thought he was being truthful.

If they can’t get him on perjury, they’ll go for corrupt intent. They’ll try to establish that the President’s description of his thought process can’t be trusted on any given issue, because he’s just all over the place. They’ll point out the inconsistent things he’s said (and tweeted) about Comey. They’ll maintain that Trump fired Comey because of the Russia investigation but that he just won’t admit it. Again, this might not prove obstruction in a court of law, but Mueller doesn’t have to do that, at least if he gets a Democratic Congress. They’ll take it from there. And, as McCarthy says, they’ll define obstruction with “a certain elasticity.”

McCarthy warns of what Trump is dealing with: “I am here to tell you that these lawyers are ruthlessly competent. Yes, Trump has been in a lot of litigation, and he has sat for many a deposition. But he has not climbed into the ring with this breed of adversary before, not with this kind of jeopardy at stake.”

Anyone who doubts Mueller’s ferocity need only look at what he did on Monday, after McCarthy's column was in the can. He coordinated with the U.S. attorney for the southern district of New York to conduct raids on the property of Trump’s personal lawyer –- that’s RAIDS, plural; one on his office, one on his residence, and one on a hotel room. Attorney-client privilege be damned; Mueller appears to have taken whatever he wanted. This shocking action seems to have crossed a line into a kind of war. The bar is extremely high for this kind of behavior, which apparently occurred with the blessing of Deputy Attorney General Rod Rosenstein, who should have recused himself from this case at the start.VOT

Perhaps this was Mueller’s attempt to goad Trump into firing him. If Democrats take Congress in November, firing Mueller will put Trump on board the impeachment train just as easily as anything Mueller could have charged him with. I have a feeling Mueller would gladly make that sacrifice.

It also addresses the stunning legal double standard regarding campaign contributions:

President Obama easily settled a claim that his campaign had hid the sources of nearly $2 million in large donations and accepted more than $1.3 million in illegal contributions, while Trump is mired in a likely Constitutional crisis and the threat of impeachment over one payment of $130,000 that may or may not even be considered a campaign contribution.

As McCarthy points out, “...what was not a crime in the Obama days is the crime of the century now.”

    Muelleran is protecting the enemies of our government, and therefore of our country. He has morphed all over the map away from the one investigation assignment he was given - Trump's involvement with Russia. That was the "nothing Burger" that Pres. Trump said it would be. Mueller is not a Republican with whom I can identify. Enough is enough. Mueller has bided the necessary time needed to try to divert the attention from the true criminals: Hillary, Obama, Lynch, Rice, COMEY, and all the minions of the corrupt government "Swamp" and all the FBI corruption. Mueller was unnecessary when he was hired to investigate, and he is simply a rat hole that we are pouring money down when we need a Wall, Puerto Rico needs help to recover, our veterans (the true heros) have a huge amount of needs, our infrastructure is waiting and bridges continue to rust, and our immigration law andorder still needs the focus of our President. Instead he is being cajoled to deal with the foolishness of Mueller's treasure hunt that is Ending up to be the elephant in the "good politics" room in our government. Mueller was plunked into the spotlight of our National Government as if he was more powerful than our President.

    Trump is now left with no choice but to fire Mueller whom has now gone so far passed boundaries of the Russia investigation. And is consistently doing so. Mueller can't be allowed to investigate whatever he wants to. The Stormy mess and campaign finance issues do not fall under the Russians. He and his Democrat minions working for him are not another branch of government. And if they WERE they would have oversight! Right now he is acting without oversight. He needs to be stopped ASAP. IF Trump is the only one that can stop this runaway train, then he must do just that. He also needs to fire Rosenstein and maybe Sessions. They should be stopping this mess and if they won't, don't, Trump has no choice.

    I believe that congress should remove the special prosecutor and end the investigation because of proven FBI bias (which started the investigation) and because the initial charge of collusion has not been proven after all of this time. Also, the bond between lawyer/client has been breached by the FBI's recent raid. In President Trump's words, "disgraceful!"

    Hi Mike, What Mueller did yesterday with the President's attorney has made all of us feel less safe. Rosenstein and Mueller have taken away a basic right to all of us under the 4th amendment. They have taken away our right to fair legal counsel and our safety of the attorney-client privilege. Many of us here in Pennsylvania and online just cannot believe we are seeing our constitutional rights being stripped of us right before our eyes. We are seeing a "Saul Alinsky" world becoming closer to reality. We are seeing an America we brought our children into being stripped away by a corrupt government. We are seeing criminals and illegals who have more rights than our own children who were born here in America, and it is especially now worse if you and your children are white. We are seeing that justice only works one way - and that there is no equal justice for all. We are seeing Mueller and Rosenstein strip our rights and for what??? - to cover their own butts in their corruption for years with the Clintons and the Obama, and of course George Soros. I pray that my President fires Rosenstein & Mueller and makes a decision to replace an ineffective Sessions (or, demote him to second to work on the drugs) - because we need someone in the DOJ who can truly support we the people and our President whom we elected.

    Trump needs to fire Sessions (Totally Incompetent), and Rosenstein (Traitor to America). Appoint someone who will redirect Mueller to what his original task was, finding the truth about election interference by the Russians. All evidence points to Hillary Clinton and the DNC. They are the criminals at the core of Russian/Ukrainian interference.

    I am ashamed to see what our justice department has became. The multitude of laws broke by the DNC, Debbie Wasserman Schultz, Hillary herself, Susan Rice, Loretta Lynch and the rest of the endless list of corrupt individuals and yet we have seen no punishment. I believe the lost/forgotten people of this country have known for some time how corrupt our government has became but if we took a poll, they would not believe it wold have came to where our justice department/establishment bodies are attempting to upstage/remove a duly elected president. I only pray God sees our country out of this darkness and Trump will finish his term as president.

    Trump firing Muller is just what they want. Then they can charge the President with obstruction of justice and go for impeachment. What he needs to do is appoint a special investigator to look into Muller, Comey and Clinton who seem to be corrupt officials. These people need to be held accountable or this country is lost.

    As much as I would like to see Mueller fired, it smells like a setup. He needs to be reigned in by the statutes already in place and to be more accountable as to his less than transparent motives. If Mueller were to be investigated , I think the discoveries may be adequate enough for him to resign on his own, as the left will eat their own the microsecond they become a verified liability.

    It actually is far past time to have fired Mueller, Rosenstein, Strozk, Page, Wray, and even Sessions. After theses latest unconstitutional intrusions into privileged communications it is time to declare these as acts of sedition against our Constitution and send Seal teams to capture the enemy combatants and incarcerate them for treason. We need a Constitutional crises if we ever shall see this nation brought back to the tri-cameral structure of ou Republic. In fact, the President should call in the media and announce his orders simultaneous to giving them to the military. This witch hunt has already done more to undermine our governing system than the Russians could ever do. If Trump needs a volunteer militia, I am easy to contact. Thank you.

    I’m afraid if President Trump fires Mueller that will cause more problems. I think Attorney Jeff Sessions should take control, be the leader and stop letting Rosenstein have so much power. Rosenstein should recuse himself. I wish be fired. I do hope this biased investigation by Mueller will end and stop wasting our tax dollars. I believe they are out of control. It is disgusting what’s going on. This was not done to Clinton. There is plenty to investigate what the last administration did. It’s staring them in the face yet they continue to destroy people’s lives and show how truly biased they are. This shouldn’t be happening. It’s disgraceful and gives us no trust in the rule of law. They are destroying that trust. I have lost faith in Jeff Sessions because he lets this go on. Investigate real crimes and what the last administration did to start this whole thing.     Many have advised Trump NOT to fire Mueller. I understand the politics. However, this is a trap either way. The Dems want to Impeach Trump for NO reason. So the best would be to FIRE Mueller NOW. Force the hand of the Dems NOW! They are the minority. The Rhino’s who are up for re-election will oppose impeaching. Dems from Red States will oppose. The Congress is used to politics as usual and corrupt at times. However if Trump slammed the brakes on this phony investigation NOW, the PRESIDENT holds the cards! He had the CONSTITUTIONAL AUTHORITY to hire and fire. The SCOTUS will have to support him. The Trump haters will not know how to fight back. If someone is out to kill you; do you WAIT and debate all “ options” or do you flip and fight NOW?

    Robert Mueller needs to end the Russian probe and focus on the FICA problem, the DOJ and FBI problems, Hillary and her email,

    clean house. Mueller went to far with Michael Cohen and "Stormy", I don't give a big rats you know what about Stormy, but I doi
    care about all the DOJ and FBI cover-ups! And I want to see Hillary, Loretta, Debbie, the 2 FBI love birds, Comy and of course Obama
    in jail for all the DNC payments on the dossier and FICA warrents, oh and don't forget Holder and "Fast & Furious" and I am not talking

    I believe this special council headed by Robert Mueller has gone WAY TOO FAR....I do think he should be fired. He is now not investigating the Russian election interference, but is hunting for anything that he can charge President Trump or his associates with, that can hurt this administration. It is such a shame and the whole Special Council should be SHUT DOWN NOW!

    I’m not sure about firing Mueller. He should fire Sessions. With a new AG, my understanding is that Mueller goes away. From comments I hear, this all has to do with Sessions recusing himself. I want to see more investigation into the DOJ and FBI. I think it’s time to give up on investigating our President.

    I have spent a lifetime watching Democratic fraud and media disparagement of regular Americans. I have been watching this distraction of our democracy and our president his family and our entire way of dealing with this COUPT.
    I, in my 71 years have never seen such corruption within our system. We are headed for a Civil War because our country is so poisoned by the injustice that is being perpetrated against our Constitution. When actual laws are challenged by not enforcing what is right and what is lawful to please the corruption of the entire party called Democrats I am very afraid at this point that if not stopped our country as we Know it will end .
    Our president is doing everything he can to survive this assassination of character and to allow it to continue to me is the greatest crime Of All.

    I voted "undecided" on firing Mueller -- don't know what good that would or would not do??? Just bring in another one?? Just this morning I e-mailed both Flake and McCain that this travesty has gone on long enough. They are acting like Nazi Germany and all for political gain. When will the Democrats realize THEY LOST THE ELECTION!! We are spending millions on this Mueller fiasco and us common folk do not like it one bit. Please do what you can to get it stopped.

    It's obvious the intent of this lame investigation is to bring down Trump. I know every Dem would vote to impeach Trump, but I worry more that a whole lot of Republicans would want Trump gone as well. I'd fire Sessions and Rod Rosenstein and then Mueller.

    Muelleran is protecting the enemies of our government, and therefore of our country. He has morphed all over the map away from the one investigation assignment he was given - Trump's involvement with Russia. That was the "nothing Burger" that Pres. Trump said it would be. Mueller is not a Republican with whom I can identify. Enough is enough. Mueller has bided the necessary time needed to try to divert the attention from the true criminals: Hillary, Obama, Lynch, Rice, COMEY, and all the minions of the corrupt government "Swamp" and all the FBI corruption. Mueller was unnecessary when he was hired to investigate, and he is simply a rat hole that we are pouring money down when we need a Wall, Puerto Rico needs help to recover, our veterans (the true heros) have a huge amount of needs, our infrastructure is waiting and bridges continue to rust, and our immigration law andorder still needs the focus of our President.     Trump is now left with no choice but to fire Mueller whom has now gone so far passed boundaries of the Russia investigation. And is consistently doing so. Mueller can't be allowed to investigate whatever he wants to. The Stormy mess and campaign finance issues do not fall under the Russians. He and his Democrat minions working for him are not another branch of government. And if they WERE they would have oversight! Right now he is acting without oversight. He needs to be stopped ASAP. IF Trump is the only one that can stop this runaway train, then he must do just that. He also needs to fire Rosenstein and maybe Sessions. They should be stopping this mess and if they won't, don't, Trump has no choice.

    I believe that congress should remove the special prosecutor and end the investigation because of proven FBI bias (which started the investigation) and because the initial charge of collusion has not been proven after all of this time. Also, the bond between lawyer/client has been breached by the FBI's recent raid. In President Trump's words, "disgraceful!"

    Hi Mike, What Mueller did yesterday with the President's attorney has made all of us feel less safe. Rosenstein and Mueller have taken away a basic right to all of us under the 4th amendment. They have taken away our right to fair legal counsel and our safety of the attorney-client privilege. Many of us here in Pennsylvania and online just cannot believe we are seeing our constitutional rights being stripped of us right before our eyes. We are seeing a "Saul Alinsky" world becoming closer to reality. We are seeing an America we brought our children into being stripped away by a corrupt government. We are seeing criminals and illegals who have more rights than our own children who were born here in America, and it is especially now worse if you and your children are white. We are seeing that justice only works one way - and that there is no equal justice for all. We are seeing Mueller and Rosenstein strip our rights and for what??? - to cover their own butts in their corruption for years with the Clintons and the Obama, and of course George Soros. I pray that my President fires Rosenstein & Mueller and makes a decision to replace an ineffective Sessions (or, demote him to second to work on the drugs) - because we need someone in the DOJ who can truly support we the people and our President whom we elected.

    Trump needs to fire Sessions (Totally Incompetent), and Rosenstein (Traitor to America). Appoint someone who will redirect Mueller to what his original task was, finding the truth about election interference by the Russians. All evidence points to Hillary Clinton and the DNC. They are the criminals at the core of Russian/Ukrainian interference.

    I am ashamed to see what our justice department has became. The multitude of laws broke by the DNC, Debbie Wasserman Schultz, Hillary herself, Susan Rice, Loretta Lynch and the rest of the endless list of corrupt individuals and yet we have seen no punishment. I believe the lost/forgotten people of this country have known for some time how corrupt our government has became but if we took a poll, they would not believe it wold have came to where our justice department/establishment bodies are attempting to upstage/remove a duly elected president. I only pray God sees our country out of this darkness and Trump will finish his term as president.

    Trump firing Muller is just what they want. Then they can charge the President with obstruction of justice and go for impeachment. What he needs to do is appoint a special investigator to look into Muller, Comey and Clinton who seem to be corrupt officials. These people need to be held accountable or this country is lost.

    As much as I would like to see Mueller fired, it smells like a setup. He needs to be reigned in by the statutes already in place and to be more accountable as to his less than transparent motives. If Mueller were to be investigated , I think the discoveries may be adequate enough for him to resign on his own, as the left will eat their own the microsecond they become a verified liability.

    It actually is far past time to have fired Mueller, Rosenstein, Strozk, Page, Wray, and even Sessions. After theses latest unconstitutional intrusions into privileged communications it is time to declare these as acts of sedition against our Constitution and send Seal teams to capture the enemy combatants and incarcerate them for treason. We need a Constitutional crises if we ever shall see this nation brought back to the tri-cameral structure of ou Republic. In fact, the President should call in the media and announce his orders simultaneous to giving them to the military. This witch hunt has already done more to undermine our governing system than the Russians could ever do. If Trump needs a volunteer militia, I am easy to contact. Thank you.

    I’m afraid if President Trump fires Mueller that will cause more problems. I think Attorney Jeff Sessions should take control, be the leader and stop letting Rosenstein have so much power. Rosenstein should recuse himself. I wish be fired. I do hope this biased investigation by Mueller will end and stop wasting our tax dollars. I believe they are out of control. It is disgusting what’s going on. This was not done to Clinton. There is plenty to investigate what the last administration did. It’s staring them in the face yet they continue to destroy people’s lives and show how truly biased they are. This shouldn’t be happening. It’s disgraceful and gives us no trust in the rule of law. They are destroying that trust. I have lost faith in Jeff Sessions because he lets this go on. Investigate real crimes and what the last administration did to start this whole thing.     Many have advised Trump NOT to fire Mueller. I understand the politics. However, this is a trap either way. The Dems want to Impeach Trump for NO reason. So the best would be to FIRE Mueller NOW. Force the hand of the Dems NOW! They are the minority. The Rhino’s who are up for re-election will oppose impeaching. Dems from Red States will oppose. The Congress is used to politics as usual and corrupt at times. However if Trump slammed the brakes on this phony investigation NOW, the PRESIDENT holds the cards! He had the CONSTITUTIONAL AUTHORITY to hire and fire. The SCOTUS will have to support him. The Trump haters will not know how to fight back. If someone is out to kill you; do you WAIT and debate all “ options” or do you flip and fight NOW?

    Robert Mueller needs to end the Russian probe and focus on the FICA problem, the DOJ and FBI problems, Hillary and her email,

    clean house. Mueller went to far with Michael Cohen and "Stormy", I don't give a big rats you know what about Stormy, but I doi
    care about all the DOJ and FBI cover-ups! And I want to see Hillary, Loretta, Debbie, the 2 FBI love birds, Comy and of course Obama
    in jail for all the DNC payments on the dossier and FICA warrents, oh and don't forget Holder and "Fast & Furious" and I am not talking

    I believe this special council headed by Robert Mueller has gone WAY TOO FAR....I do think he should be fired. He is now not investigating the Russian election interference, but is hunting for anything that he can charge President Trump or his associates with, that can hurt this administration. It is such a shame and the whole Special Council should be SHUT DOWN NOW!

    I’m not sure about firing Mueller. He should fire Sessions. With a new AG, my understanding is that Mueller goes away. From comments I hear, this all has to do with Sessions recusing himself. I want to see more investigation into the DOJ and FBI. I think it’s time to give up on investigating our President.

    I have spent a lifetime watching Democratic fraud and media disparagement of regular Americans. I have been watching this distraction of our democracy and our president his family and our entire way of dealing with this COUPT.
    I, in my 71 years have never seen such corruption within our system. We are headed for a Civil War because our country is so poisoned by the injustice that is being perpetrated against our Constitution. When actual laws are challenged by not enforcing what is right and what is lawful to please the corruption of the entire party called Democrats I am very afraid at this point that if not stopped our country as we Know it will end .
    Our president is doing everything he can to survive this assassination of character and to allow it to continue to me is the greatest crime Of All.

    I voted "undecided" on firing Mueller -- don't know what good that would or would not do??? Just bring in another one?? Just this morning I e-mailed both Flake and McCain that this travesty has gone on long enough. They are acting like Nazi Germany and all for political gain. When will the Democrats realize THEY LOST THE ELECTION!! We are spending millions on this Mueller fiasco and us common folk do not like it one bit. Please do what you can to get it stopped.

    It's obvious the intent of this lame investigation is to bring down Trump. I know every Dem would vote to impeach Trump, but I worry more that a whole lot of Republicans would want Trump gone as well. I'd fire Sessions and Rod Rosenstein and then Mueller.
