The Comey Memo

The New York Times is reporting tonight that President Trump asked former Director Comey to stop the Flynn investigation.

In effect, the Times, based solely upon the word of James Comey, is insinuating, if not directly stating, that the President obstructed justice.

I have serious questions about James Comey's credibility in this regard.

18 USC § 4 reads: "Whoever, having knowledge of the actual commission of a felony cognizable by a court of the United States, conceals and does not as soon as possible make known the same to some judge or other person in civil or military authority under the United States, shall be fined under this title or imprisoned not more than three years, or both."

This is called misprision of a felony.

Concealing knowledge of a felony and failure to report is, itself, a felony.

First, if the former FBI director was taking notes of meetings where the President had allegedly told him to drop a criminal investigation (i.e., to obstruct justice), then why did Comey wait until now to reveal this? In fact, by keeping his notes private until now, he was concealing them. Right? (That is the first element of misprision -- concealment.)

Second, if Comey did not reveal this information "as soon as possible ... to some judge or other person in civil or military authority under the United States," then that means only one of two things ---

(A) Comey did not think the President had committed any crime, or

(B) Comey was committing a crime, himself, (i.e. misprision of a felony) in order to have something to hold over the President.

On the other hand, if he did, in fact, reveal this to a judge, or to the Attorney General, or to any other person in authority, then by revealing this information to the press, Comey may be impeding an active investigation.

So if these memos actually do exist, this does not look good for Comey. Which makes me wonder if they do, in fact, exist.

If I were Comey, I would certainly lawyer up and plead the 5th if he is called to testify before Congress.

    Since July 5th, 2016; I have found it hard to believe anything Comey says. He is more of a politician than those elected

    It seems pretty obvious to me that Comey is a low life pissed off fired employ who is out to get President Trump and was stupid enough to make the mistake that someone like Mike Huckabee would be looking our for President Trumps back.

    Seems to me the media is out to get Comey by reporting this bs. They hate him for having a hand in Hillary losing, so they think, and now he is in the cross hairs. The media is stupid and full of themselves. But they still have some people who listen to them.

    Wasn't Flynn cleared by the FBI in January? Didn't the meeting in question take place in February?

    As always, a voice of reason...The constant barrage of hysteria by the left towards President Trump has gotten beyond out of hand...The lack of support by the "REPUBLICANS" is disturbing...

    I am so tired of this back and forth nonsense because the Democrats did not win the presidency! The Democrats need to stop trying to bring down President Trump when there are more pressing issues to take care of. Clinton lost the election, so they need to get over it!!

    Comey is as guilty as the rest of the corrupt liberals and RINOs. They are all running terrified of being caught and know they will be. They can't shake or rattle Trump, but they keep trying. Kinda like the definition of insanity..doing the same thing over and over expecting different results. Or are they just banging their heads against the wall because it feels so good when they stop? Comey messed up. He needs to pay the price.

    James Comey is not the man many seem to believe he is. Corrupted by power and personal ego as we've all witnessed this past year.

    I personally hope to see the Clinton investigation reopened, not only to see swift band due justice carried out, but also to expose or "get to the bottom" of the directives he was surely given by Obama and Lynch to discontinue the email investigation and never investigate the Clinton Foundation.
