IS THE RIGHT TO PROTECT AND OWN PROPERTY STILL SACRED IN AMERICAN LAW?

Do you know one of the greatest rights you have as an American? You can own property. That’s not the case in many places around the world. In China, you can only lease land from the government. You pay, but you never own it.

Owning property and having the right to protect it and not have it taken, used, or destroyed is sacred in American law. At least it used to be.

Recently, St. Louis attorney Mark McCloskey and his wife were about to have dinner on their patio when hundreds of protestors broke down the gate of their privately gated home and descended on their property and threatened to kill them and their dog and burn their house. They called the police, but none came. They retrieved guns and appeared on the porch and told the trespassers to leave. The protestors, seeing the legally owned guns in the hands of the homeowners, decided to move on. But arrests were made from the incident. But it wasn’t any of the mob who broke down a gate, trespassed on private property, and threatened innocent homeowners on their own property who got arrested. It was the McCloskeys. They were charged by local leftist prosecutor Kimberly Gardner with a felony. Yep. Despite the 2nd, 4th, and 5th Amendments to the Constitution and Missouri state law called the Castle Doctrine that guarantees someone to defend their property and person with lethal force if they feel threatened by a trespasser, the loony local DA did nothing to the mob and charged the homeowner with crimes and even confiscated their legally owned firearms. To make it worse, a member of Gardner’s staff allegedly asked the crime lab to alter their firearms once they became evidence. So I do agree someone should go to prison for all this, but it sure isn’t the McCloskys!

Things are upside-down in our country when a government official ignores crime and the people who commit it, but who then criminally charge law-abiding citizens for exercising their rights and protecting their very lives. Even though the MO attorney general has taken steps to intervene and get these nutty charges nullified, and Governor Mike Parsons has pledged he will issue a pardon to the McCloskeys should these bogus charges get successfully prosecuted, the outrage shouldn’t subside. In the rioting and looting that’s taken place in St. Louis in the past few months, not one person has been prosecuted by Kim Gardner for setting fires, looting stores, or throwing objects at police officers. She believes that’s acceptable and defensible behavior. But protecting your property and family? She’d love to lock you up.

President Obama famously said, “elections have consequences.” Man, was he ever right about that! Electing people like Kim Gardner, or Mayors like Bill DeBlasio in NY, or Lori Lightfoot in Chicago or Ted Wheeling in Portland results in putting criminals, thugs, and mobs in the driver’s seat and leaving law-abiding citizens with the responsibility of protecting themselves. This year’s elections will be about many issues, and response to the Chinese virus will certainly be one of them. But if we don’t stop the virus of having elected officials encouraging mob rule and the destruction of private property, and worse, the loss of life by even 1-year-olds to random gun violence, then the virus of uncontrolled crime will kill far more of us than COVID ever did or will.

Despite the vicious and hostile prosecution of the McCloskeys for simply defending their lives and property, as you can tell, they are wealthy enough so as to be able to defend themselves and will probably win in court anyway. But what about YOU? If you can’t defend your home, your family, and yourself all while the police have been defunded or demoralized and sidelined by crazy mayors and governors who justify violence and chaos, then will you be charged with a crime for trying?

When you vote in any election, above what candidates tell you they will do about taxes, or health care, or jobs, you better know what they will do when YOU are threatened to have your property or life taken from you. Will they stand with the criminals or with you? And I don’t care what party they represent if they won’t stand with you, why on God’s earth would you ever stand with them?

YOUR TAX DOLLARS AT WORK

Your Tax Dollars At Work: The federal government gave this guy $5 million to subject federal employees to “diversity training” that consists largely of browbeating, shaming and guilt-tripping white people into thinking that everything about them is intrinsically racist. So why are we paying taxes to promote racism?

WHY SOCIALISM WILL NEVER WIN

Here’s a good illustration of why socialism will never defeat the fast-thinking ingenuity of capitalism except by brute force. In New York, Gov. Andrew Cuomo imposed another capricious COVID-19 (Chinese) coronavirus restriction, allowing restaurants to remain open but ordering bars to close.

So how are bar owners responding? “Would you like to see our new food menu, featuring such delicacies as the ‘$1 Bowl of Chips’? That’s right: we’re a restaurant now!”

Of course, the "sentry" decided my forwarding this was some kind of threat. It does seem like the whole world is against sanity these days and President Trump has gotten a good share of that heaped on his shoulders.

For once I disagree with you Mike. Every year my mortgage company pays my land rent through the escrow account. You don't own it, the government does. Just quit making that rent each year and see who gets the property.!

For the note on the property. When our Constitution was being formed the thought was the pursuit of life, liberty and property. But it got changed to life, liberty and the pursuit of happiness in the debate by our founders.

Where are the water canons? Appears to me that these useful devices need to be put into play. Those rioters with no respect for private property and businesses need to be removed from the scene...whatever it takes. How have we elected so many spinless nitwits?

    Dear Gov.
You are under the same misconception that most Americans are.
WE DO NOT OWN PROPERTY (REAL ESTATE) IN THE USA!!!
What we own is "TITLE" to property. I forget when the laws shifted to this distinction in violation of the Constitution, but, let your guys look it up and you will find that you don't own that house on the beach.
    Hope this helps.

Just wanted you to know that I tried to forward a video on a very reasonable and well-thought out commentary from an American citizen to Congress about term limits. Of course, the "sentry" decided my forwarding this was some kind of threat. It does seem like the whole world is against sanity these days and President Trump has gotten a good share of that heaped on his shoulders. We can only pray that his shoulders hold up and God gives us another 4 year reprieve from those who want to destroy America. Of course, we can expect another impeachment try, but only prayer has gotten him this far.

I would have done exactly as the McCloskeys did, and I would not have submitted to arrest by these stinking, fascist pig democrat prosecutors (i.e., persecutors). I used to say that war was coming, but now I think its here, right now. The Second Amendment was meant to be a final barrier against tyranny, according to those who wrote it. That means use of force against all enemies, foreign and domestic.

When I read your blog, I am enraged and sickened. Why? because my law career as an ALJ in New York was demolished by a corrupt Disciplinary Committee, a corrup Referee who invented a witness and evidence (you read that write and a corrupt Appellate Division. Not a single law firm or attorney would stand up for truth ir justice in Democratic Party run Brooklyn NYC. I might as well have been in Soviet Russia or Communist China!

    I kid you not.

We have the RICO law - the Racketeering influenced Corrupt Organization law, and now is the time to use it. Start with Kim Gardner in Saint Louis, Sissy Boy Wheeler in Portland, and ditzy what's-her-name, the so-called mayor in Seattle. Mayor Looselip (SP?) in Chicago got the message just in time, but a couple of indictments of these other folks might motivate a few others to get their heads out of their sand-box.

Egregious examples like the McCloskeys and others take entirely too long to go through the "legal" process, and even when they do and win, nothing happens to prevent a repeat (i.e. the prosecutor doesn't loose there job or the judge doesn't get disbarred). All we are doing is putting out small fires, not eliminating the kindling. If the only answer is at the polls perhaps massive recall efforts should be started at each incidence of this kind of behavior. We could start with the mayors of several cities, governors of several states, along with several judges and prosecutors. At the very least it would give them something to occupy their time.

As MLB opens the season why bother having the stars and stripes flying overhead? The employees take a knee when the families think about the lost family members defending the flag before the games all they ask if you could stand and just say thanks; no they bring BLM to the park and thank them with a knee to the ground. The NBA does the same only thats not enough they praise the China Communist party while praising slave labor, human abuses, non existent freedom, women abuse and so many more human abuses the NFL what mockery their employees present, the commissioners takes advertisement money to join the military then the employees kneel in mockery toward the ultimate sacrifice they make, just so you have the freedom to mock them Pound Sand MLB NBA NFL. I had paid to park buy a ticket eat at the concession stands maybe stop after the games for a beverage after you pound sand pucker up and kiss my ass.

Thank you for remaining a fair and balanced source of information.

I am the lucky one to own a parcel of land in West Central Florida that is almost always under water, a paradise for the hydrostatic scrubs that populate the area. Taxes are very low and there is no threat of insurgents desiring to usurp control. Everything in life is relative and if you do not aspire for worldly acclaim you will be rewarded with peace of mind and soul and God's little acre in the sand!
