Consequences In The Senate

Senate Democrats are trying to use budget reconciliation to force through their massive coronavirus bill, but acting like you’re the king when you have a 50-50 tie can create consequences. Republican leader Mitch McConnell plans to use the process against them by dragging it out and forcing Democrats to go on record as voting for dozens of measures they’d rather keep quiet about, from paying illegal immigrants to showering more money on schools that refuse to open.

As much fun as that sounds, it’s predicated on the dubious assumption that today’s Democrats have a sense of shame. We already know they back every America-destroying, budget-busting, Constitution-shredding idea that ever rolled out of the pages of The Daily Worker. All this does is put it down on paper. Still, make them put it down on paper.

Trump Official Sues Biden Administration

Another example of using the left’s own tactics against them: Roger Severino, a Trump appointee to the Council of the Administrative Conference of the United States (ACUS), just became the first Trump official to sue the Biden Administration. He was reappointed in January to a three-year term that is supposed to continue no matter who becomes President. Severino says he was threatened with termination if he didn’t resign from the board, which is illegal.

Letter Sent To DHS Secretary

A number of Congressional Republicans have written a letter to DHS Secretary Alejandro Mayorkas and acting director of ICE Tae Johnson, pointing out that President Biden’s order of a 100-day moratorium on deportations with no exception for violent criminals constitutes “a wholescale abandonment of law enforcement and a frustration of the will of Congress, written into the law, that aliens with final removal orders actually be removed from the country.”

The letter reminds Mayorkas that during his recent confirmation hearing, he repeatedly vowed to respect the rule of law. I’m not a legal expert, but that sounds like a solid perjury case to me.

This Is Very Revealing

Sen. Rand Paul drilled down on Secretary of Education nominee Miguel Cardona about President Biden’s order to let males who “identify” as females compete in girls’ sports. Watch Cardona squirm, evade and change the subject as he tries to defend this policy without admitting the obvious: he knows it’s a ridiculous attempt to deny biological reality that will destroy girls’ sports. He can’t say so publicly for political reasons, but he knows it, and he’s going to enforce it anyway.

Somehow, I can’t help suspecting that if they’d been rightwing activists, that headline would've been phrased quite differently, and the word “hatchets” would’ve turned up somewhere.

It’s great to see so many readers engaging with us, commenting --- both pro and con --- on our voice of reason at this time of mass hysteria. We’re trying to get through all the letters, promise! Here are responses to two more...

I just have three quick questions:

1.) Since Senator Patrick Leahy is presiding over the 'impeachment' trial, does he have a vote on conviction? The Chief Justice does not have a vote, so why should Leahy, since he is assuming that capacity.

2.) What gives Senator Leahy the authority to preside anyway? I cannot anywhere in the Constitution that says this it is permissible for a Senator to preside over an impeachment trial.

3.) The impeachment articles were delivered AFTER Trump had left office, and was a private citizen, What gives the Senate the authority to try ANY private citizen?

The short answer: none of this is constitutional. They are making it up as they go along.

Having Sen. Leahy presiding over an impeachment trial is entering uncharted territory, since the Constitution says “the Chief Justice SHALL preside...” Chief Justice John Roberts has wisely chosen not to accept this dubious honor and will play no part in the "trial," so Sen. Leahy has graciously taken it upon himself. I assume he will decide for himself whether or not his vote counts. My guess is that it WILL. This whole circus is already so unconstitutional that, hey, why the heck not?

So, with President Trump already out of office and the Chief Justice not presiding, is what we have even a real impeachment trial? I’m not a legal scholar by any means, but I certainly have a lot of company in saying it is not. What we have here is a big fat banana-republic-style show trial. Your friend is correct in saying the Senate does not have authority to try a private citizen.

Accordingly, Trump’s attorneys are arguing that this entire process is unconstitutional, not only for the reasons mentioned above but also because the House impeachment was conducted without any due process. They also say that Trump is innocent of the charges he was impeached for, having never incited violence, and that they can present evidence that the Capitol breach was planned well in advance of his speech.

Democrats want to "convict" Trump because they think it will prevent him from holding office again, ever. They said he didn’t deserve to in their legal brief filed February 2. (The "trial" is scheduled for next week, starting February 8.) But legal experts point out that they don’t have this power other than with appointed offices, not elected ones. And to do this, even if it were constitutional, they’d have to reach a 2/3 vote on conviction, which they are not going to get.

Will this common-sense argument stop the Democrats? Of course not. But Sen. Lindsay Graham has said that if they call even one witness, Republicans will call a slew of their own, tying up the Senate for weeks at least. Maybe they'll even call the guy in the Viking helmet, if only to establish that he was there at the Capitol long before Trump gave his speech and didn’t even hear it.

Personally, I’d like to see the Republicans call John Sullivan, the left-wing activist who participated, was arrested and charged but then violated terms of bail. What was he really doing there?

I’d like to know how many other left-wing activists were involved in the Capitol breach. Again, we know the so-called insurrection was planned quite a while in advance and had nothing to do with what Trump said.

On the other hand, Trump’s attorneys say they won’t be bringing in the issue of election fraud. It apparently is not true that Trump parted ways with his previous team over that issue. New attorney Bruce Castor said, “There are plenty of questions about how the election was conducted throughout the country, but that’s for a different forum, and I don’t believe that’s important to litigate in the Senate trial because you don’t need it. President Trump has plenty to win with what he has.” Here’s more from THE EPOCH TIMES.

Jonathan Turley warned that even the House impeachment –- not even counting the Senate trial –- was doing great damage to the Constitution.

Turley said, “With seeking his removal for incitement, Democrats would gut not only the impeachment standard but also free speech, all in a mad rush to remove Trump just days before his term ends.” He said that Trump’s speech did not meet the legal standard for “incitement” and would be seen by the Supreme Court as protected speech. This sounds like just the kind of defense Trump’s attorneys are planning for his trial.

"The damage caused by the rioters...was enormous,” Turley said. “However, it will pale in comparison to the damage from a new precedent of a snap impeachment for speech protected under the First Amendment.” Of course, the House did it anyway.

Thanks for allowing me to comment, Governor. I am very disillusioned, with the Republican "club," and you. For two or three years, you have been chicken little on these CIA/FBI pending indictments. Time and again you breathlessly announced that charges, indictments and jail time was coming. The Democrats are destroying America with unbridled activism and relentless action while the "club" stonewalls and stands around in togas, all the while complicitly skewering Trump. Disgusting. 74 million Americans will not soon forget this insider treachery. Loyalty is supposed to work both ways. I wish Trump would start a 3rd party.

Thanks for writing, Paul, but I think you mischaracterize my reports. The investigations have been interminable, and I don’t think we’ve ever said anyone was going to jail. We’ve said people DESERVE to go to jail, which is a different thing entirely. I share your abject disappointment and disgust that no one has been held accountable.

We can tell you what investigators have turned up, and we can point you to solid sources and great books exposing much of the deep state, but as for accountability, well, we can’t do anything about that, much as we would like to.

So, you put me, personally, in “the club,” wearing a toga, standing complicit as the Democrats skewer Trump? Aside from thinking I might look pretty silly in a toga, I have to wonder where on earth you get that image of me. I ran for President; didn’t QUITE make it. I have no power to put anyone in jail, as appropriate as that might be. I've made it crystal clear what I think about the double standard of “justice” in Washington DC.

Right now, increased activism is the very thing I’m encouraging for embittered Republicans. As for starting a third party, that would be the worst mistake conservatives could possibly make. Democrats are hoping beyond hope that we do. Start a new third party, and conservatives will never, ever, ever win another Presidential election. Ever. Guaranteed.

    So boys want to "play" being a girl so they can win at girls sports. My comment is simple. If the boys really mean it and are not just looking for attention, have they had their cocks and balls removed so they will be "more like the girls they wish they could become? Talk can be so cheap.

    Good morning Governor Huckabee! Wow, thank you for the wonderful Scriptures, so encouraging always!
    I do this daily on Facebook. The way the Holy Spirit showed me, 'Facebook' and other social media can be used for 'good' such as well as those who use it 'worldly, evily'. And with that I determined with the 'desire' in my heart (knew it was God!) that after the death of our son at age 43, in his prime in the Army was 'taken out' by the 'spirit of disease, cancer' with only 9 months but oh he accomplished much in that time and he 'awaits us' in the Kingdom of God and one day we will be 'reunited' and it WAS from my willingness to 'fight the adversary, Satan', that 'ol spirit of death' that wanted to 'take me out with such tremendous grief and sadness' I 'determined' from God's conversations with me that as I 'encouraged' others in Facebook it would be 'seed planted' that 'came back 100 fold' to me in 'wisdom, insights, encouragement' and the 'will to live a life abundant' of compassion and love toward others in spite of this traumatic blow of our son leaving this planet far too young and yet, daily I have great insights and a sense of closeness with him from our Lord. God is so good and marvelous to us in these types of issues, thank You Jesus. And, since 2013 (Jack Jr passed 12/13/2013) I have missed only one time on Facebook to give encouragement and wisdom through the Word of God.
    Thank you for who you are and for Sarah, I simply love her and BELIEVE God is going to move her to a 'position' for Arkansas that will catapult this State into greatness!

    I believe the Senate has already voted that this impeachment is unconstitutional. Couldn't that be grounds for impeachment of both Leahy and Pelosi for pushing it through? As much as "incitement" would be good to see, is it not just as simple as them going against the Constitution and their vow to uphold it. I know, we might have to impeach most of the Congress that way but if someone went after the big guns wouldn't that help?

    Oh, and by the way, I love how Trump lives rent-free in so many of their heads!

    I disagree with you about a third party! I'm sure the Whigs made these same statements to the Republicans when they started that party! With the number of spineless jelly fish establishment Republicans that control that party, we are all but running like the hogs the demons entered on our way to the river to be drowned! They don't want us {Trump supporters} unless we conform to their ways! They promise everything and deliver practically nothing! We lose if we stay so we might as well lose for awhile while building a new party! When we reach that goal, the republican Party will join its predecessors in the political grave! Sorry, Governor, but they brought this onto themselves! we tried and tried but continually failed!

    The absurdity of the Biden mission to destroy the Country is very evident. The GOP RINO party is in step with the destruction. The MAGA is real and should be the country's battle cry as we put America back together after China's invasion with a biological weapon called the China Virus. Stand down approach to this invasion is not the answer being a coward is what the country is doing now.. When Pearl Harbor was bombed we reacted today we shut up and people that remembered the bombing are being exposed to the virus in hope more elderly people head for an earlier grave dead people don't speak out at this invasion just like FB Twitter and the rest want you silenced this may seem a dark version and view I think 75 million people feel it and the number is growing. The population has been asleep Wake up America you are assaulted by the Biden group of thugs and you no longer have to guess your election does have consequences and Biden voters are reaping its benefits.

    I am actually for a "Republican" party that weeds out any RINOs by looking at all their past actions, and associates before we vote them in. I am for looking at every Republican in currently, and any RINOs being voted out. Their voting record and who they associate with will tell us that. Mitch M. is one who has terribly disappointed me in this manner. I even sent donations to him, which I want back as he is not who he portrayed himself to be in my eyes. I do not know about a 3rd party? I know that there are SOME (few) Democrats that are disgusted by this whole thing, there must be, who might join a 3rd party that has enough of what they want and enough of what Republican's want? I just do not know. I am so disgusted with the legislators right now, it is not funny!

    I think the intent of the framers' is obvious. Impeachment was included to remove a sitting President from office before the end of his term, not as a petty and vindictive way to wag a finger at a President after his term expired. If this goes through and is upheld as constitutional, who should we impeach/cancel next? All of the Presidents who were slave owners? Maybe try them all collectively? Personally, I think we should start with Andrew Jackson. The Trail of Tears was genocide.

    Why don't you interview Joe? Ask him if he agrees with men using the same restroom with young girls and women. Then ask him if he should be sued when the inevitable happens even though the female's total life will be forever ruined. Why not be more like R Paul and get down to brass tacks about these issues that ruin American lives and that we are paying to have ruined without any recourse. Make them squirm. Make them answer yes or no instead of evasive answers. Assert your religious beliefs which this country was founded upon. Use your God given political clout for more than just pontificating. Frankly, I admire your beliefs but am frequently not subjecting myself to just more talk. It just doesn't mean much if you don't use your talents for more than just blogging every day. Take your words to the source so that maybe something will get through to the left. Thank God for the Rand Pauls of this country. Your daughter is an example of what I am trying to convey. She is actually doing something instead of just talking and she is quite an effective speaker also.

    Mike whatever happened to all the Election fraud? Was it all baseless as mainstream media proclaimed? I heard Mike Lindell is planning on releasing a documentary non the fraud Friday morning. Even if this did prove fraud and that Trump won by a large margin, would it make any difference at this point? What would the possible outcomes be? Apparently Lindell has lost count of the amount of death threats he's experienced. What are they, the left, hiding? Thanks for keeping us informed.

    I have heard that some states are reviewing the votes. The mail in ballots without a postmark counted days after the election were declared illegal. Will there every be a judge with the ah spine to actually look at the evidence? All refused to look at evidence for one reason or another.
