December 5, 2019

While there’s a lot of talk about the blatant bias and lousy, lazy legal scholarship of “expert” witnesses on impeachment yesterday (Jonathan Turley the lone exception), we shouldn’t overlook the fact that a couple of them are also proven liars.

Now, I don’t use that term lightly. Unlike the anti-Trump media, I would never claim someone is “lying” when they express an opinion I disagree with or make a different interpretation of facts.  I’m talking about making demonstrably, provably, deliberately false statements while masquerading as an allegedly honest and unbiased expert.  I mean flat-out, bald-faced whoppers on the level of a TV weather forecaster swearing on his professional reputation that it’s raining meatballs outside.

For instance, take Stanford Law Professor Pamela Karlan (please!) It wasn’t bad enough that the Democrats brought in a known far-left radical so filled with unhinged partisan bile that she mocked the President's 13-year-old son’s name and admitted to once crossing the street because she couldn’t emotionally handle walking in front of a Trump hotel.  She also has a demonstrated history of making blatantly false statements about Republican Presidents while posing as a legal expert.

Former US civil rights federal attorney J. Christian Adams reminds us that in a published law review article, Karlan (who worked in the Obama DOJ) wrote this: “For five of the eight years of the Bush Administration, [they] brought no Voting Rights Act cases of its own except for one case protecting white voters.”

At the link, Adams (who worked on the case fighting the discrimination against white voters and won it) lists the many such cases brought during the Bush years. There was only one year in which there were no federal lawsuits filed under the Voting Rights Act by Bush’s DOJ. In four of the years, there were multiple cases, and four cases in 2008 alone. Remember, Kaplan’s false claim was in a published law review article for which she was presented as a reliable, unbiased expert. As Adams notes, she has never retracted that false claim, nor been held to account for it by her peers.

And there’s no excuse for Congress not knowing of her history of bias and dishonesty, since Adams writes, “I even testified to the House of Representatives about her dishonest scholarship in 2012.”  (Maybe that’s when Democrats made note of her name for future reference.)

And let’s not overlook fellow argument against sending your kid to an Ivy League law school, Harvard Prof. Noah Feldman.  He stated to the House during his testimony:

“Until this call (to Ukraine’s President) on July 25th, I was an impeachment skeptic.”

At this link, journalist Mike Cernovich compiled a Twitter thread of Feldman’s many arguments for impeaching Trump, dating all the way back to shortly over a month after he took office in 2017.

His multiple previous claims of Trump’s definitely impeachable offenses range from Tweeting that Trump Tower was wiretapped (we later learned it was) to “Russian collusion” (which was later confirmed to be a hoax.)  In other words, he has a long history of claiming that practically everything Trump does is an impeachable offense.  Yet he testified to Congress that up until this July phone call, he was an “impeachment skeptic.”

That wasn’t a tossed-off remark, it was meant to bolster his status as an honest, unbiased and dispassionate legal expert.  Or as some might say, it was a lie designed to mislead Congress and the American people.

Ask yourself, if any conservative legal expert had a clear record of such bias and dishonesty, would House Democrats ever allow them to testify?

Okay, that’s a trick question: Even if a conservative legal expert had a 100% spotless reputation for unbiased honesty, these House Democrats would still never allow them to testify.

The terrible reviews of Wednesday’s House “impeachment” hearing are rolling out all over, with even an analyst at admitting it was an unconvincing failure (FYI: “The trial was a pig circus, he never had a chance” is a Bob Dylan lyric, not a commentary on the Schiff/Nadler hearings.)

Ann Althouse is a law professor, not a media figure, so her pan of the proceedings is especially interesting and carries real weight.

But for pure entertainment value, you can never beat Kurt Schlichter.

There are two other reactions to the hearing worth noting. One, surprisingly, was a perfectly appropriate reaction that actually came from chairman Jerrold Nadler, who at one point represented all of America when he appeared to fall asleep:

And this has to be the Line of the Day, the best and most succinct description of this entire “impeachment” fiasco that I’ve heard anywhere. Glenn Reynolds (a real law professor) of the Instapundit blog spotted it on Facebook and quoted it without attribution:

“It’s like Watergate, but with morons.”

In what I assume is a play for the small number of remaining Kamala Harris supporters’ votes, Joe Biden teased that he might pick her to be his Vice Presidential running mate.  He told reporters, “Senator Harris has the capacity to be anything she wants to be. I mean it sincerely.”

(Pro Tip: Always be skeptical when a politician tells you anything during an election year and follows it with “I mean it sincerely.” If he really meant it, he wouldn’t need to add “sincerely.”)

He went on, “She is solid. She can be President someday herself.”

To unpack why he probably doesn’t mean any of that, sincerely or otherwise: Being Vice President doesn’t necessary mean you’re Presidential material.  Some might argue that applies to Joe, who made two disastrous Presidential runs before Obama chose him for Veep (in 2008, he dropped out after garnering less than one percent in the Iowa Caucuses.)  When Harris dropped out, she was at 7% in her own home state.

Of course, there are always miracle comeback stories, like Nixon in 1968.  And maybe Joe will actually clinch the nomination on his third try, although if so, it’s largely because the rest of the field is so awful. But that includes Harris, who was actually losing badly to Joe Biden!

But if Biden does become the nominee, is he sincere about picking Harris as his VP?  Why? Even if she were wildly popular in her home state, it’s California. The Democrats could run Bonnie & Clyde and win California. They need someone who can help them carry one of the swing states they lost to Trump.  When Harris dropped out, she was at 3% in Michigan and 1% in Pennsylvania (no wonder Democrats hate the Electoral College!)

Maybe the DNC poohbahs would pick Harris as an identity group candidate, thinking she would attract black and female voters. Personally, I think it’s insulting to believe people will vote for a candidate whose policies are harmful to them just because they share the same race or gender, but that’s the current mindset of the Democratic Party (it worked out so well with demanding that all women vote for Hillary or be called traitors to their sex.)

So sure, there’s a chance that Biden could pick Harris. But if the Democrats want to “balance” Joe with a younger, female minority running mate, I assume they’re smart enough to find one from a state they lost in 2016 and that they need to win.

And when I say "I assume they’re smart," I mean that sincerely.

She’s “Deluge-onal”: Hillary Clinton claims she has been “deluged” with requests to run for President again.  Even if that were true, I’m assuming most of the requests are from Republicans.

So now every time the majority in the house is a different political party from the political party of the president, they will impeach the duly elected president. Why has nobody sunk that low before!!!

The more people listen to politicians the people would like to move to a place where they are seldom heard and the sky is blue most of the time. I see where Al Green is talking; what a great resource, we had 8 years of a person of color in the white house we had a peanut farmer in the white house we had texans in the white house all politicians, and they were miserable Presidents. We have a Business man in the white house now; now my guess Is 70 million people are going to say lets keep him there. My hope is politicians never make their way back to the White house and you guessed it Al I wish you would leave DC along with 200 hundred of the miserable politicians that are there now. That is just a start, My wish is the miserable Politicians would become endangered species without protection . Al put up a mirror or go to a clothing Department store and take a look in the mirror what will look back at you is a miserable Politician. IMPEACH YOU and don't forget your sisters Maxie and Talib and Omar Miserables>

A month ago just keep talking was my battle cry for the Socialist party that controls the House and the wannabe Presidents are making the case they will come on done. Look at the former VP attacking an elder citizen of the US. The speaker of the House that over 30 years in the House worked to keep Abortion, Keep religion away from the society is now hiding and probably lying behind the Catholic Church. The Ten Commandments are part of the Church watch her on rerun TV she has violated a lot of them thats her deal. This election coming up is about hate for America this election is coming to the point of does the Country want to be a Socialist Country or the Country governed by the Constitution . We need to rid the House of Socialist members I hope to live for at least 10 more years I love my simple free life style I have wonderful children and grandchildren it would be so painful to see them live under a Socialist regime they don't deserve that most conservatives think about the children's future where Socialist don't give a dam the beauty of sub standard living and restrictive living appeals to them.

If the (F)articles of Imcoupment pass the house & sent to the Senate. If it doesn't get thrown out because of the Schiff opening statement and all the other improprieties, Can the ruling include an order that tells the house to quit with the harassment.

Can a vote of "no-confidence" on Nancy "I don't hate the president" Pelosi, be held to replace her.

    Oh, Honorable Huckabee.
Your words are just so perfectly picked, they make a bouquet of colorful humor presented at the end of my workday. The anger and disgust I feel when these demonic tyrants of the left play their game of lies, soaks into my soul. It is difficult to clean off. I see our fragile democratic republic being bludgeoned and torched daily. We know who the real target of this stalinistic coup is us...the American people. Not too much longer and the American voter will be mere slaves of the evil aristocracy of totalitarianism. We have to fight back. Apart from calling senators and congresspeople, what can I do? I am ready to fight.

You haven't mentioned this subject yet, but as I was watching some complaining about the democrats next debate not have much diversity. You know, mostly old white men. But I thought that they could remedy this easily enough. The democrats say that if you sincerely feel like you are a woman instead of a man, then that has to be respected and no questions ask. Also if you sincerely believe that you are black or Mexican or Muslim instead of a white man, then that has to be respected and no questions ask. So if the democrats at the debate feel that the complainers have a problem, then all they have to do is say they sincerely believe that they are a transgender or transrace and it's taken care of, and supposedly without complaint according to the dedicated democratic party.

Mr. Huckabee: Professors Feldman and Karlan lied with intent to fool the American people. They both lied about witness testimony. They used witness opening statements admitted to be presumption and hearsay having no basis in fact under questioning to build a case to impeach our President. As I was listening, all I could think of "is this a joke".

You know I am disgusted with Congress. They haven't done anything but spend our money on this impeachment. President Trump is doing a great job. I wouldn't want to go through all the things that he has been through.

I am wondering why this Professor is still at Stanford for all her lying etc. She should be fired for what she said yesterday about Barron, I thought you could not pick on children of a President! I would think that being Stanford they would want someone they could trust to teach a class because after all it is a very expensive school and they just don't take anyone. Maybe she should be at Berkeley instead, I am sure she would fit in much better over there.

I hope most people are as sick about the impeachment as I am. Someone said that if they vote to remove my PRESIDENT Trump from office we would have another civil war. I think a lot of people are to that point.

As an octogenarian who has attempted to stay involved since my First vote for JFK in 1960, I find todays political Circus mildly amusing for the part the media is playing to thier own detriment. Do these supposedly highly educated people not understand how fragile this Republic is when half the country BELIEVES Socialism if Good, Capitalism is Bad? and they are cheerleading the Dims who are "throwing out" our Constitutional Responsibility while IGNORING the Oath they took to protect same? Again this would be Funny if it wasn't so serious.

FYI. IN JUNE, TICKETS TO PANAMA (the country), anyone remember Jimmie Carter, drop to <$600 round trip. You can still vote, like all the expats there, but you escape the constant toxic flood of blue sludge flowing out of D.C. They had a clinton type in power there and he was arrested, does that mean Mena, Arkansas is a sanctuary city?

    Governor Huckabee:
I wonder how many of these Democratic Congressmen and women would like to be on trial without having due process? I pray every night that the Republicans will regain the House, win a larger number of seats in the Senate and that President Trump will be re-elected in 2020. Thank you for your honest news. It keeps me from wanting to tear my hair out.

Lord; protect us from the insanity and evil of the Democrat’s! I’m just a regular citizen. I’m a mother and a flight attendant. I’m wholeheartedly sick of the blatant lies and attacks on our president, his family, his staff, and our Judeo-Christian values. It’s got to END. Round them up and charge them with Sedition and Treason. Start with everyone last December on Nancy Pelosi’s 757 on their weigh for European support against our duly elected President Trump.
