Investigative reporter and opinion writer for THE HILL John Solomon must have had himself cloned, as he’s simultaneously breaking big news on more than one front.  In a week with so many developing stories, it’s hard to know what to start with, but let’s look first at the serious allegations concerning Bill and Hillary and the Clinton Foundation, because this news has been such a long coming.


When chants of “Lock her up!  Lock her up!” were heard from the floor of the 2016 Republican National Convention, they were met with criticism from Democrats who claimed to be concerned about due process.  (Of course, the Kavanaugh confirmation hearings later proved that they don't care about it one bit, but I digress.)  It should be said that we as law-and-order conservatives would not abandon due process in Hillary’s case –- we just want to see the due process take place –- but “Lock-her-up-after-finding-her-guilty-in a-court- of-law!” just doesn’t carry the punch needed to work very well as a floor chant.

Anyway, we’ve been hearing about problems within the Clinton Foundation for years, anecdotally, from its own employees, lawyers and auditors.  From our admittedly limited perspective, on the outside looking in, it just didn’t seem on the up-and-up.  Over the years, it collected about $2.5 billion to help with global crises ranging from AIDS to natural disasters, and anyone who questioned its legitimacy was accused of not caring about all the good it did in the world.  The default defense whenever it was challenged was, “Well, it does so much good.”


A charity can do some good works and still be as corrupt as can be.  And we may find out soon just how corrupt, now that a package of 6,000 pages of evidence (95 exhibits) attached to a 48-page whistleblower submission has come to light.  The report was secretly filed in August of 2017 --- more than a year ago --- with the FBI and the IRS.  It was put together by MDA Analytics LLC, a private firm run by top-notch former federal criminal investigators.  They allege that the Clinton Foundation broke the law and may be subject to millions of dollars in delinquent taxes and penalties.


MDA reportedly undertook this investigation on its own, thinking that if its whistleblower report resulted in the IRS recovering back taxes and penalties, it would receive a government reward.  But shortly before the midterm elections, the IRS sent the firm a “preliminary denial letter” stating that it did not pursue the allegations for a number of reasons, including lack of resources (!), and possible expiration of the statutes of limitations.  (I wouldn’t be surprised if these expired while the report languished on somebody’s desk for a year.)  If you’ve ever had to suffer through an audit, you must be pretty mad right now. 


Still, It looks as though action is finally being taken at other agencies.  The firm has had contact with prosecutors at the main Justice Department office in DC and FBI agents in Little Rock, where much of the investigation appears to be taking place.  And suddenly last week, a federal investigator –- I’m guessing it’s John Huber in Salt Lake City, who was assigned the Clinton Foundation case many months ago –- asked for documents from the private investigation.


Some of the exhibits are from legal reviews that the Foundation conducted on itself in 2008 and 2011; these found serious problems with legal compliance, improper commingling of personal and charity business (especially with Bill Clinton, who commingled to a highly concerning degree), and (yes) “quid pro quo” promises made by Hillary while she was Secretary Of State.


In particular, one exhibit is an interview the private investigators had with CFO Andrew Kessel in 2016 in which he testified to these concerns and said he “knows where all the bodies are buried.”  Kessel confirmed to them that both internal assessments had “found widespread problems with governance, accounting and conflicts of interest.”


The 2008 report, written by private lawyer Kumiki Gibson, said that the work of the Foundation and former President Clinton were “intertwined in a way that creates confusion at, and undermines the work of, the Foundation at every level” and warned that this “poses reputational and legal challenges...”  It specifically warned that the Foundation had not created policies and procedures “required by law” and observed that some of its leaders “appear to have interests that do not always align with those of the Foundation.”  It said managers had an “anti-compliance attitude” and that lower-level employees had “begged” for whistleblower protections after witnessing “less than fully compliant behavior or even worse are asked to participate in or even condone it.”


It was the 2011 report by the law firm Simpson Thacher that specifically raised the issue of “pay for play.”  “Some interviewees reported conflicts of those raising funds or donors,” it said, “some of whom may have an expectation of quid pro quo benefits in return for gifts.”


Curiously, after being interviewed by MDA, Kessel also had a sit-down with FBI agents who paint a different picture.  They say he never implicated former President Clinton or the Foundation in any illegality.  Not sure how believable the FBI is these days, though, especially on matters relating to the Clintons.


The Clinton Foundation has released a statement saying the allegations are politically motivated and “have been proven false time and time again” (really?), and that the Foundation “has demonstrably improved the lives of millions of people across America and around the world, while earning top ratings from charity watchdog groups in the process.”


Solomon asked six investigators to review the report and key exhibits, and they all said that although federal agencies have their own legal experts to address issues of tax-exempt compliance, the evidence of potential criminality was strong and warranted the opening of an FBI or IRS investigation.  Retired FBI supervisory agent Jeff Danik, a CPA who helped the FBI make some of its most complex financial fraud and terrorism cases, called the report “a very good roadmap for investigation.”


Congress is looking at it, too, and it’s a good thing they have a roadmap, because they have only a few weeks before the gavel is turned over to (shudder) Nancy Pelosi.  A Republican-led (for now) House Oversight subcommittee headed by North Carolina Rep. Mark Meadows (for now) has a hearing scheduled for next Thursday to review Judge Huber’s investigation of the Clintons –- not just the Foundation but Hillary’s use of a sneaky private email server to transmit classified information.  He wants to find out how much in terms of money and resources from the DOJ has been devoted to this probe and whether action may be expected from Huber on anything relating to the Clintons.  Two of the whistleblowers from the MDA investigation are scheduled to testify in public for the first time.


One thing I hope the committee asks:  If the Clinton Foundation is really a charitable organization, set up purely for altruistic reasons with no expectation of quid pro quo, have you found any explanation for why donations dried up after Hillary lost the presidential election?

    Mr. Huckabee: I would like to know if you agree with me that the initial motive for Hillary setting up the private e mail server was the Memorandum of Understanding (between the Clinton Foundation and Obama Presidential Transition Committee) and her Letter to James Thessin (Ethics official at the State Department). Obama required these documents in return for appointing her Secretary of state. Both documents promised Hillary would avoid conflicts of interest and even the appearance of conflicts of interest between the Clinton Foundation and her activities as Secretary of State. She was supposed to notify Thessin in writing of activities that could be a conflict of interest. It would be interesting to know if she ever sent Thessin a single such communication. To me these documents show that Obama knew Hillary could not be trusted to resist opportunities for pay for play so he tried to hem her in. I seem to be the only person drawing this conclusion but it seems so obvious.

    as a resident of New Boston, Texas, which is extremely close to Arkansas, both North and East, I have watched these 2 criminals evolve from Little Rock, to Washington.

    I remember the 2 teenagers found near a Clinton ran airfield. I’m 100% sure I know why they were killed. The Who is probably six feet under too.

    As a USAF Veteran, I was fighting the drug wars using RADAR, and it was my privilege to do that. We both know Texarkana’s history and it played into Bill and Hillary’s life. That was Arkansas and Texas side both!

    I am personally excited this story is out. I hope the ball continues to roll and gains steam, before Pelosi takes over.

    This is long overdue and I am waiting for something to come of it to show America our justice system is fair on both sides of the isle and also politically connected and regular people. Comey is such a slimy lying grandstanding piece of work! Keep up the good digging!

    I'm in Scotland and have been watching things unfold for some time. I have to say that I am greatly disappointed that the Clintons, Obamas and George Soros are still roaming the country free as birds and making speeches, as well as undermining every positive step President Trump makes to get America back to being a great nation. With all the evidence that has already surfaced, they should surely be in custody instead of being able to continue with their anti American agenda. If they are to be stopped and humanity saved, then action needs to be taken now, before Pelosi has a chance to bury the whole thing once she takes over as speaker of the House. Every single one involved with the Clinton Foundation, the Obama scandals and George Soros's Organisations needs to be rounded up and charged with the crime of subversive actions against America. But these aren't the only ones who need to be dealt with. There are also the Judges and Activist Lawyers who seem intent on destroying the American way of life by favoring Illegal immigrants and Muslims over American Citizens. If the country is to be saved, then the DOJ needs to make some drastic replacements on the benches and in Law Offices. The lawless behavior of these judges and lawyers cannot be tolerated or ignored. They are acting against everything America stands for. Time to put an end to the rule of the Clinton/Obama/Soros Cabal...time the swamp was not just drained but totally cleaned out.

    This has been in Papers for quite sometime and it is very FRUSTRATING. Don't Republicans have any good Lawyers anymore? The "Clinton Cash" book by Peter Schweizer has been published long time ago and even the late Charles Krauthammer had dissected the book in detail yet the Clinton Foundation seems UNTOUCHABLE and the Clintons are laughing at the American people; free as the birds.

    I hope I am wrong, but I would be more than surprised if anything happens to the Clinton crooks ! Too many corrupt people in some of the top agencies protecting them. And then you have the Democrats who will do anything to protect their special alliance with Bill and even more so Hillary. The swamp is so deep and so corrupt. The Republicans have very little time to actually do something and push this forward at a very fast speed before the Democrats gain control of the House.
    Still can't believe and am disgusted that in the mid-term election, the crooked lying Democrats gained control of the House. What happened to all those Americans who felt so passionate in 2016. Did they become complacent or didn't care, or was there just too many crooked elections that made sure the Democrats won? The Republicans, Patriots, etc. will have a little less than two years to wake up and they should have more than enough proof why we cannot ever, ever again have Democratic control anywhere !!!!!!!
    And then today we see the arrogance of several more crooks from the Obama era, like Comey, Brennan, etc. running around and making their lying statements to the lying liberal mainstream media. The swamp is ever so deep, but maybe, just maybe there will be some pursuit of justice against the Clintons, Comey, Lynch, Holder and the list just goes on and on. Time will tell if Americans who believe in the Constitution and justice will ever see true justice against this group of elite crooks who think they are above the law and so far have been!!!

    With the corruption at such a high level in Washington DC, We may never know the truth during our lifetime. Unless people start dropping like flies, as they did in other Clinton investigations, the subject of their criminal activity will enter the Obama dark transparency world and allow the Democratic Socialist Congress to get control.

    Some years ago I was working for a non profit charitable organization. I believe we had the highest rating according to those who rate charities. One day I checked out a few other charities on the charity rating websites. I remember looking up The Clinton Foundation on, I think, Charity Navigator. (I suppose it could have been Forbes. Not really sure.) I seem to remember reading that The Clinton Foundation did not meet the standards to be considered a charity. Then sometime later, when Hilliary was running for President, I looked them up again and found it odd that, all of a sudden, they were a legitimate charity with a high rating. I didn't believe it. I believed that liberals were in charge of Charity Navigator and/or Forbes and did not want anything to come between Hillary Clinton and the Presidency. I don't know if there is any way to confirm any of this, but thought I would pass it on.

    I read an article where Hillary put 1.8 BILLION dollars into the Bank of Qatar about 6 weeks before the election. It was evidently foundation money as the phony foundation was having a shut down of some sort then. My question is how can a charity do any good when they funnel the funds into a bank in a foreign country with no extradition and where are the taxes they supposedly paid on that money? The entire Clinton crime family and we are talking Comey, Lynch, Obama, Podesta, Brazaille, Mueller and so many more should be swept out of the country to GITMO. I use the term "Lynch/Comey Act of 2016" because all Comey did is cement the dual justice system in this country with the exoneration of Hillary and the very phony FBI farce of an investigation. They and most democrats all seem to be above the laws that conservatives have to follow and if we vary an inch, we are penalized, they on the other hand go on daily with no consequences. Forget Wray at the FBI, he is just an empty suit. America will never be right until and I put this bluntly Governor, till she swings from the highest tree in the land.

    Forgive me, Mike, but once the House Oversight Committee has completed their hearings, isn't the record going to be totally hidden by Nancy Pelosi and Co.? What action will be taken? We have seen that Pelosi and Co. have a contempt for the very idea of our Constitution. They could care less for the letter of the Constitution, and have a whole slew of Supremacist judges to dismiss any possible consequences that might issue from an investigation of one of their friends. I know that you are just as good as it gets to say what you say, but you also know what I mean that this country will get nothing done on ANYTHING as long as the Democrats run the House.

    All the people demand and deserve is equal justice under the law. this requires investigation, prosecution and her day in court. if she can they can present a plausible defence, then we can retain our faith in American justice. these years have been difficult for us.
