As we head into the weekend, the focus is once again on the Department of Justice, with multiple breaking news stories. First, in a dismaying development, they’ve decided after two years not to press charges against former deputy FBI Director Andrew “Andy’s office” McCabe for his “lack of candor” with FBI investigators concerning a media leak he approved.

McCabe was asked about this on CNN, where he now works as a paid contributor (surprise), and he lamented having to wait so long to find out he wouldn’t be charged. Former U.S. Attorney Brett Tolman commented on FOX NEWS Friday afternoon, saying to those who see “inconsistency” that we should “appreciate a Justice Department that takes its time to thoroughly investigate, makes the tough decisions. It illustrates that Barr is independent, that the Justice Department is looking at the merits. And...I’m okay with the Justice Department when they decide not to bring a case. And, let’s face it, we’re all hoping that we can de-politicize the Justice Department.”

Well, that’s putting a positive face on it. He seems to be saying that what we see as “inconsistency” is actually a good thing: a sign the DOJ acting objectively, without regard to politics. Okay, but, it still looks like yet another example of the two-tier justice system. Members of Team Trump are investigated to within an inch of their lives, convicted on process crimes and given long prison sentences, while members of Team Hillary skate away to big-money book deals and contracts as contributors for CNN and MSNBC. As that is incongruous with our view of the “new” DOJ as run by Bill Barr, I have to postulate that there’s something more to this that we don’t know. (There better be.) It’s a developing story, having just been announced, and we’ll learn more soon.

In the meantime, the media will run with the headline and paint McCabe as the straight arrow in this story, the intended victim of Trump’s retribution. Never mind that he really did oversee media leaks and mislead investigators and also that he was apparently in on the “insurance policy” scheme with Comey, Strzok and Page --- none of whom have been charged, either.

This news sparked a rant from Becket Adams at the WASHINGTON EXAMINER that I think you’ll appreciate.

Also, it was announced Friday that the DOJ is hiring an outside prosecutor to review former National Security Adviser Michael Flynn’s case. As you know, Flynn is now mounting a vigorous defense through powerhouse attorney Sidney Powell and is trying to change his “guilty” plea. Tolman commented on this story as well, saying, “The entire Flynn chapter screams of politics. And then you start to see what’s been uncovered during the investigation –- that there was doubt in the investigators’ minds as to whether or not he was actually lying...Then you have the 302 reports, and that there were some mistakes made in there. So I LIKE that he’s doing this. Look [the attorney general’s] been around, he is bright, he is strong, and he works hard, and I hope this starts to squash all the discussion that the attorney general is just going to do what is politically expedient. He is not.”

“It’s a good move to get to the bottom of what happened in that prosecution,” he concluded.

It does seem to be a positive move. A hard look at what was obviously done to railroad Mike Flynn is just what he needs now. Let’s hope that’s what he gets.

Justice Department taps outside prosecutor to review handling of Michael Flynn case

Mike, I must say that I am really angry that Democrats and the Barrack Obama deep state get away with murder. They are guilty of many things that are dead wrong and walk away with no accountability or punishment. The corruption at every level in government has got to be confronted!

The statement that jumped out at me was: "Tolman commented on this story as well, saying, “The entire Flynn chapter screams of politics" because it could be said that “The entire IMPEACHMENT chapter screams of politics".......

THE IMPLICATION OF THAT STATEMENT BEING THAT politics is inherently lacking in justice...and truth....because it only cares about winning and will do whatever it takes TO win!!!

I ask did our founding fathers have to deal with this form of "politics" when they penned the Constitution? If NOT, then that fact alone made the Democrats' articles of impeachment against their "political" opponent a farce!

Thanks Governor! This helps calm me down but I am still skeptical that the obvious Hussein Hellary abuse of power, election interference and presidential coup attempt will not be fully prosecuted and exposed. My anger is for more political retribution which ends up in a perpetual conflict not to unlike the Muslim and Jew hatred that never ends because the attacks on both side never ends. But this is more of good vs evil endless battle. I do believe that one side needs to totally win to put a final end to the evil. And for my two cents the evil is with the baby murdering lust for power and juvenile democrats

dI think the phrase "Bigger fish" is appropriate in this instance. The same applies to Comey. I Am sure that Barr has many more serious crimes than just a lie. If not then there is zero justice and Flynn and Stone are prime examples. however, with all that is going on in GITMO and the grand jury impaneled by Durham, something big is about to come down. I have sen more than once, Barr joking and saying "half of congress is going down/to GITMO" So something is about to happen. When all is revealed, half of DC is not going to be celebrating.

I’m sorry, but it just makes me so angry that no one on the left are being held accountable for all of their criminal behavior! If something isn’t done, this criminal behavior will just continue. What is wrong with the DOJ?

I'd heard stories of a (not taught in school) separate category of citizenry (sovereign citizen, I think is the term) available to those wealthy enough to know how to buy their way in for life, that has permanent immunity from the laws the ordinary citizens (i.e., all of us commenting here) are subject to. I'm beginning to think they're not fairy tales. Deep Swamp Dwellers must be charter members. Makes as much sense as any other reason I've seen as to why high-placed bad people are consistently exempted from the laws of this country. Need a stronger spotlight cutting into those murky waters.

I don't know who McCabe's Lawyer is but he should get some kind of award for getting this guy off the hook( so far?) OR we Still have a two tiered Justice System. I'm sure I would be wearing stripes like the other Trump supporters who got caught up in the Witch Hunt for Impeachment.

There has to be more to this story. AG Barr is too wise and too fair to play partisanship like this, not on either side. At least, he seems to be.

This seems to be just more political corruption and confusion and in my mind at least is another never ending story that we likely will not see the truth or an end of . My trust in government has been destroyed , Not that I had much anyway . I do tend to side with President Trump and can only hope he is not just another part of the vast Swamp . The Swamp runs deep and wide .
Thank you for being on the side of truth .

Just a brief comment on a, like always, great article on McCabe. I'm tired, and pretty sure all average Americans are , too, of the systematic unfair application of the law in this country! Calling McCabe lies just "lack of candor: underscore the two-tier justice system that is still alive and prospering in this country. McCabe lied, Brennan lied, Comey lied, Clapper, lied, Schiff lied, Pelosi lied, a bunch of corrupted "elite Democrats lie ... and no one ever is indicted or even worse, goes to jail! Any Conservatives or anyone associated to this president is harassed, their lives destroyed, and sent to jail on the flimsy of accuses. There is no justice anymore. AG Barr seemed a fair guy, and we still waiting since last August for the criminal report to come out. What a waste of taxpayers funds and other valuable resources a ... and the Deep State go scott-free. I'm ashamed of how bad this country has turned out to be in spite of Trump's efforts. Still too many RINOs in the party while the Dems continue the mob rule and vote in block. If this situation will persists, I'm afraid the People will resort to self-justice or total anarchy ...

It sickens my heart every time I see one of these liberals who have clearly defied regulations and laws while trampling the constitutional liberties of conservatives and Trump Supporters, get off Scott free! Where is the balance of justice. I am so tired of hearing the lame excuses. Someone needs to grab their balls and prosecute the criminal activities of every one of these conniving Liberals.

I’m am so despondent over this. Nothing is ever going to happen to these evil liars and crooks. We are all getting our hopes up for nothing, I’m beginning to not pay attention any more. There is obviously a two tier justice system, the common citizen like us, would go to jail and be ruined for things the FBI get away with as well as illegal aliens....who get released from jail for accused crimes we’d need millions of bail for and a probably conviction and jail time and these people just walk free. It would be unbelievable but its really happening. No one is evidently ever going to turn this around ever!! Like I said depressed and despondent.

This may be a dumb question but can you Please explain how an outside prosecutor is going to help or be better and did Barr make this choice??? I’m confused. Is it because the DOJ is not trustworthy?

There's a two nagging questions lurking out there begging for answers:
    1. Why is it those who were part of the failed coup are still out walking around?
    2. Did McCabe get the sweetheart deal to become the next John Dean? Or, is it just another case of the swamp rats taking care of their own?

    Dear Governor Huckabee,

I am just a old Arkansas country boy who had a 2.3 GPA in a PE degree. Recently in the CNN Don Lemon interview with Rick Wilson and Wajahat Ali, Wilson mocked my non-prejudiced (yes you 3 geniuses, that exists in the south, more than not in my neck of the woods) southern fly-over land roots by calling me a "rube". I knew it was making fun of me, my friends, my family, my heritage, and my beliefs. His arrogant, demeaning tone and facial expressions of better-than those-people attitude signaled a clear message to even to a limited deplorable like me. Well Governor, to tell the truth, I am such a country bumpkin that I had to look it up to see what it meant. Now I know a synonym for country bumpkin, perhaps my first baby-step in becoming enlightened or, should i be so lucky, getting "woked up".

I thought Barr was finally a hope of truth and justice, but from this decision not to prosecute Andrew McCabe, he is looking more to me, a simple nobody rube remember, like just one more "Swamp Thing" taking care of the elites and covering the butt of federal government. I keep hoping that he did this strategically for now, but is working behind the scenes and spotlights to find the mother-load of truth on these corrupt "leaders of our country". And then by prosecuting, convicting if guilty, and putting them in prison like the rest of us would be with "Stone-age" heavy sentences. So, is there any possibility of McCabe being revisited and possibly charged? Or is this just another case of the two-tiered justice system that insulates progressive elites?

Reminds me of a statement in the movie by Clint Eastwood, The Outlaw Josie Wales, "...don't pee on my back and tell me it's raining!" For America to stay America and not devolve into a socialist, communist, country led by tyrannical elites blinded by their arrogance and ignorance, we have to win at least these obvious battles; McCabe, Comey, Page, Strzock, both Clinton’s, Schiff, the Biden’s, Brennan, and the rest of their gang. Barr was the best hope that I've seen so far and now I have doubt that he is the real thing. Is he the real thing? Or is he just, as we rubes in Arkansas say, another chocolate-covered dog turd? Sweet-looking when you see it, sweet-tasting when you lick it, but nasty when you bite into it and discover it's still a dog turd?

Stay at it Governor, I pray for you daily as I cling to God, my Bible, my family, and my guns!

    Nobody, M.Ed., M.A., Ph.D.

PS - Grad school was easier than the gen ed requirements of undergrad. It gave me a place where my ADHD gift could thrive. Typical Rubish pattern!

I agree to a point. As long as they even it out on the other side of the aisle and eliminate the charges placed on Michael Flynn and the other Trump supporters such as Stone and Manifort. General Flynn especially should be exonerated, drop charges and he should be paid back every penny he lost through the process. As far as Manifort, sure, he was into some bad stuff, like Podesta as a matter of fact. But is the heavy sentence fair when comparing it to what Podesta has done? And solitary confinement??
All that aside, I believe Barr is waiting for the Durham report to get some of these guys on the bigger “political sins” like all the FISA lies. I think we will see justice for Comey, and all his gang of Trump coup haters at a later date. He just needs to dot every I and cross every T so that it holds up in Court with hopefully, a non biased jury. Tough job these days, but we can hope and we can pray. The left will continue to pull these stunts if they see no consequences for doing them. Justice is the only hope we have to put a stop to this kind of antics.

Mr. McCabe should be prosecuted. Some one at the DOJ must have blinders on not to see what was going on.

"....they’ve decided after two years not to press charges against former deputy FBI Director Andrew “Andy’s office” McCabe...." Unless AG Barr and/or others have 'better' charges with which to indict this whack, what part of there is no longer any "EQUAL JUSTICE UNDER LAW" do they NOT understand? McCabe has not even had a zero-dark-thirty raid pulled on his adobe as did Roger Stone and certainly is NO LESS guilty, short of possible witness intimidation, than is Mr. Stone! What part of 'witness intimidation' were these people involved with by both the raid on Stone's home and the "solitary confinement" of Manafort did people NOT witness? As ole John Stossel would say, 'GIVE ME A BREAK!'

"We The Serfs" are still WAITING for those 'promised' perp walks for ALL those involved with this attempted bloodless "Coup D'etat" on a sitting President of The United States of America. I don't recognize the America I grew up in, but then it did not resemble some 'Banana Republic.'

Please tell me that this is not the beginning of a ‘carpet sweep’ where all of these people who thumbed their nose at the law get away with their crimes. I expected better than this from Barr, but it appears to be business as usual. Had any one of us Deplorables do what McCabe did, we would already be in jail. This goes beyond disappointing.

Very disappointing news to me for Comey and McCabe who are leakers and liars. I hope the DOJ has something up their sleeve to bring justice on these two heads...
