Kavanaugh and the case for mistaken identity, Part II

After I suggested mistaken identity as a likely explanation for Christine Blasey Ford’s certainty that Brett Kavanaugh was her attacker, an article appeared that reinforces that theory.

I had said that both Dr. Ford and Supreme Court nominee Kavanaugh seemed utterly sincere in their testimony before the Senate Judiciary Committee on Thursday.  Elizabeth Loftus, a cognitive psychologist and professor at the University of California, Irvine, says it’s absolutely possible that both actually ARE sincere.  After spending decades researching human memory –- specifically, how it can change based on suggestion and other factors –- she says it’s very common to misremember details of an experience, particularly a traumatic one.

She says some “core” details might be remembered but peripheral ones not so much.  That echoes what Dr. Ford herself said in testimony, as she tried to explain why she didn’t know where the party was or how she got home.  But over time, memory changes, according to Loftus, especially with exposure to new information, and that’s something Dr. Ford didn’t go into.  “Changing the details of an actual memory is a relatively easy thing to do,” Loftus says.  “And it can happen spontaneously.”

What about victims who are “100 percent certain” of the identity of their attackers, as Dr. Ford said she was?  “Sometimes people are very, very certain and wrong,” says Loftus.  That’s just the point I was making in bringing up The Innocence Project, which uses DNA to exonerate people who were wrongly convicted and given long prison sentences for violent crimes.  There have been many innocent men sent to prison for decades because the victim in the case was “100 percent certain” of her attacker’s identification.  Literally hundreds have been exonerated through DNA testing.  Mistaken ID is the cause of 70 percent of wrongful convictions.  If victims and other eyewitnesses were always right about this, we'd have much less need for an Innocence Project.

Perhaps a victim remembers being pushed into a room or onto a bed, for example, but isn’t clear on who did it.  She’s always going to remember certain details central to the attack itself, but, over time (in this case, 36 years), other details may come to be remembered quite differently from the way they happened.  These might even include the identity of the attacker.  The victim becomes convinced of that person’s guilt and even can create vivid new “memories” of what happened.  Every time the mind replays them, they are reinforced.

Of course, someone in Kavanaugh’s situation can misremember, too, perhaps because of too much alcohol.  A perpetrator may become totally convinced he’s innocent when in fact he isn’t.  So how can we tell that Kavanaugh really is as innocent as he genuinely thinks he is?  Well, we can look at his calendar to get an idea of what he was actually doing, consider his basic nature and values, how he lives his life, what his legions of friends and colleagues (male and female) who have known him for most of his life say about him.  The allegations against him are just wildly inconsistent with what his longtime, close acquaintances know about him.  So it seems highly unlikely that he ever did such a thing.

Anyway, mistaken identity would account for the overwhelming probability that Kavanaugh is 100 percent innocent while Dr. Ford is 100 percent sure he’s the one who attacked her.  This is the problem with automatically believing the victim in every case.  It doesn’t mean the victim is lying, just that she’s 100 percent convinced of something that might be wrong.  Of course, that doesn’t matter one bit to Senate Democrats, who are 100 percent desperate to keep Kavanaugh (or any Trump nominee) off the Court.

Your Fake News Alert for Saturday:

One of yesterday’s big stories, waved around like a bloody shirt by Senate Democrats, was that the American Bar Association was calling for a delay in Judge Brett Kavanaugh’s SCOTUS confirmation vote until the FBI investigated the evidence-free allegations against him.  The request was conveyed to Sen. Grassley in a letter from ABA president Robert M. Carlson.  Yeah, about that…

Turns out that Carlson took it upon himself to write the letter and didn’t bother getting the approval of the ABA’s Standing Committee on the Federal Judiciary, which rates judges.  The committee issued a swift rebuttal, noting that the committee is independent of the ABA (meaning Carlson had no right to speak for them), and that their previous rating of Kavanaugh was “not affected.”  For the record, that rating was “well-qualified” by unanimous vote. 

Maybe Mr. Carlson should consider running for president of the American Baloney Association.

 Not enough evidence

Sen. Jeff Flake caved to the Democrats and joined the cry for yet another FBI investigation into Judge Brett Kavanaugh after some women accosted him on an elevator and demanded to know how he could vote to put that man who attacked a woman onto the Supreme Court. 

Just ponder that for a moment: thanks to the hysteria whipped up by Democrats who have exhibited open contempt for due process rights and presumption of innocence, those women, and I’m sure many others, actually believe it's been established as fact that a man with three-plus decades of sterling public service and exemplary character is guilty of heinous behavior 36 years ago because of an unproved accusation by one person who can’t produce a scrap of evidence, whose witnesses all deny it, and whose story is filled with holes.

How many holes?  Rachel Mitchell, the nonpartisan, objective, female prosecutor who specializes in sexual abuse cases and who questioned Kavanaugh’s accuser before the entire nation on Thursday, said that based on the answers she received, she not only would not have taken this case to court, there wasn’t even enough evidence to request a search warrant to look for any evidence to try to take it to court. 

And yet, Democrats, in cynical defiance of the Constitution they took an oath of office to protect, have convinced a large swath of the nation that he’s guilty, guilty, guilty!  Do they really believe that the cheap political advantage they earned by destroying a man’s reputation, bringing death threats to his family, and shredding the very concept of innocent until proven guilty was worth it?  Sadly enough, I’ll bet they do.

If Ms Mitchell’s assessment of the case against Judge Kavanaugh is not enough to convince someone that there’s no “there” there, Sen. Ted Cruz, who is a Harvard law grad and former Texas Solicitor General and UT law professor, went through the allegation piece by piece to demonstrate why this is a genuine example of a case that “no reasonable prosecutor” would ever take to court.

Israel's announcement

I hate to distract the media’s attention from such serious matters as the latest fantasmagorical allegations against Republicans from sleazy porn star lawyers, but this week, they sort of overlooked Israeli Prime Minister Benjamin Netanyahu revealing a bombshell in every sense of the word. 

In an address to the UN in New York, Netanyahu said he was disclosing for the first time that Iran has another secret nuclear storage facility in Tehran containing as much as 300 tons of nuclear-related equipment and material.  Netanyahu alleges that since Israel obtained a cache of Iran’s nuclear secrets and revealed them to the world, Iran has been trying to hide the evidence by clearing out its atomic warehouse and moving its massive stockpile of nuclear materials to other places. He presented visual aids showing the location and capacity of these alleged nuclear facilities.  Netanyahu also praised the US for reimposing sanctions to stop Iran’s nuclear ambitions and blasted European nations for helping Iran bypass sanctions.

In response, Iran denied the allegation, with a spokesman declaring convincingly that the “world will only laugh loudly at this type of false, meaningless and unnecessary speech and false shows.”

I’ve got a pretty good sense of humor, but I’m not laughing.  Are you?

 Trump signs spending bill

There was some talk of President Trump refusing to sign the latest $854 billion spending bill and sparking a government shutdown, which I’m sure Democrats would have loved to demagogue just before the election.  But he went ahead and signed it, saying he’s pleased with it overall, although he objected to the huge levels of spending that somehow still failed to include full funding for his promised border wall. 

Trump said the bill does contain additional funding for border security, including $1.6 billion to continue building a wall; plus increased funding for school safety, mental health and opioid abuse, and record defense spending, including the biggest pay raise for military members in a decade.  As for the full funding of the border wall, the White House said they will “have that discussion after the election.”

Frankly, after voters saw their Senate in action on Thursday, I imagine a lot of them wouldn’t mind if at least half of it got shut down for good.

    Schumer has been in government positions since 1981 - he says things and acts like he is President of the United States. Thank God he is not. He has been in government too long and seems he is the authorization of Congress. I would never vote for a Democrat in these times - they are leaning socialistically and culture changing. President Trump is working on all the items he campaigned to do and yet the Democrats bash him, late TV so-called comedians tear him apart and the media never mentions his good - they make up fake news to help bring the Democrats back to power. If the GOP worked this way, it would be war. Schumer said that Kavanagh is 'bitter' WHAT!! Would Schumer put his tail between his legs and smile it's OK to ruin a long career, good standing as father, husband, public servant and community leader? We need to have legislation against allegation that are produced that have no truth to them -- they are setting this whole thing to accept as guilty what hasn't been proved. They are saying more..more..more. They have already misaligned this man and his family. What more do they want - to execute him for a few beers when he was 17? How many of you have a few beers? Or did so in high school 36 years ago? Maybe the Dems will try to bring in a priest who can tell us what his confessions were about when he was 17. They are that low. What's in THEIR pockets?

    Slander is an untruthful oral (spoken) statement about a person that harms the person's reputation or standing in the community. Because slander is a tort (a civil wrong), the injured person can bring a lawsuit against the person who made the false statement. If the statement is made via broadcast media -- for example, over the radio or on TV -- it is considered libel, rather than slander, because the statement has the potential to reach a very wide audience. I hope the Democratic Party is soon disbanded. They are hurting America with this horrific act to destroy a person before it is proven that he did it - even the injured party does not know.

    I am a Vietnam veteran and a no party affiliation registered voter. Upon enlistment into the U.S. Navy I took an oath to protect this country and constitution against enemies both foreign and domestic. My view of the Kavanaugh fiasco, to me, is not about keeping him off the bench because of fear of Roe vs Wade being overturned or that a woman's choice to abort might be removed (which removes all choice from one person), but the fact that he is a constitutional judge. It is my opinion that the Democrats wish to fundamentally change the constitution and they will oppose anyone who will defend it. They wish to use the Supreme Court to overrule the constitution since they know it would never fly through congress. To me, these politicians have violated their oath of office and I consider them domestic terrorists. Of course, it's very likely that they only mouthed the words of the oath in order to gain power and prestige and they are not going to let such a solemn vow stand in their way.     In the last two weeks our Country, and the world have been spectators to the ultimate travesty in the history of the United States Senate.
    The setting was allegedly a confirmation 'hearing', by the Senate Judiciary Committe, of a Supreme Court nominee.
    No such 'hearing' ever took place. None was ever intended.
    Instead, what we observed was a trial by a group of cowardly individuals obsessed with the complete destruction of the nominee, his principles, and his unblemished reputation.
    His "crime" Being the nominee of the President whom those individuals have openly declared to hate and oppose.
    His "punishment"? The most vicious character assassination of a Supreme Court nominee in the history of the United States , including Judge Bork and Justice Thomas.
    Those democrats have neither ethics nor integrity.
    However, their conduct is an accurate reflection of the contemptible value system of the democrat party.

    I know the world doesn’t understand how we followers of Jesus can seek for purity and the desire to live a single-minded life. I was raised in a Catholic family, went to Catholic school, and had priests and nuns who taught us well and lived their lives before us. These teachers pointed the way to Christ by denying ourselves and picking up our crosses to follow Him daily. Of course it was also following a religion, but the heart of it was spiritual. Back in the ‘50s and ‘60s, we were taught modesty. We spoke with clean language, as did our parents, and there were only certain movies the children could see. We had chaperones and things about sex were not a part of our vocabularies. I loved my brothers and sister and I obeyed my parents and teachers. It was a life style. My brother attended an all boys Catholic high school, and he was instructed by Jesuits in D.C. He was a virgin. He showed respect for girls and you have got to know Jesuits were tough on discipline, as were the nuns. What i’m saying was we were taught very well, we knew our boundaries, and we wanted to obey in order to please the Lord. I kept myself pure and we certainly didn’t drink. None of us had run ins with police, crime, and worldly stuff.
    It breaks my heart to see what a circus and disgrace things are in the United States today. I know this is a spiritual battle which is fought in the heavenlies. I know we are not fighting against flesh and blood. But it sure hurts. I am embarrassed by things going on in D.C. in our government. What is the world saying about us? It certainly can’t be good.
    As for President Trump, what a turn around in his life. He has earned my respect and I will vote for him again and encourage others to do the same. Just like some of us, he does say things I believe because he didn’t get the spankings or his mouth washed out with soap when he was a child, that causes some of the coarseness in his life. But look what the Lord is doing in his life now. Now that blesses me.
    I appreciate the leadership you continually dole out daily in your newsletters, mostly because I believe it is truth and your words are honorable. I don’t look at you as a hero, but rather as a man of integrity and that is because you are also a follower of Christ. I know behind every man is a greater woman, so I know why Sarah has turned out well. All I can say is I’m praying for you. Keep up the good fight of faith because God is real. Kathy

    Why hasn’t anyone addressed the absence of any such pattern with Kavanaugh. As a psychologist Dr Ford should be well versed on this. I had a very similar experience at 17 and while it really frightened me at the time and it is a bad memory, I was not permanently traumatized. And I certainly remember where I was and how I got there. But I was not drinking.

    Last week I was so angry at the liberals for their treatments of Judge Kavanaugh. This weekend, with constant prayer, God Almighty has brought peace to my heart and blood pressure:
    -his 10yr. Daughter was right: pray for them all. They must live with so much anger and hatred that this is how they respond, led by their father of lies, the devil. How sad for them. So I’m now praying for those who are reviling, persecuting, and saying all kinds of evil against (him, us) falsely for Jesus’ sake (Matt. 5:11).
    -and The Living God of the Bible is more powerful than he that is in the world: if God wants Judge Kavanaugh on the SC absolutely nothing can keep him off and if God doesn’t want him on the SC absolutely nothing can put him on.
    Praying for all sisters and brothers in Christ and especially holding up the Kavanaugh family, friends and supporters. And you and your family, as well, of course! Thank you for standing strong!

    this is an aside to an earlier comment about the need to investigate additional folks. I think the FBI should investigate the Congressional slush fund for coverup of sexual misdeeds. Obviously, this is a misuse of taxpayer funds and must be illegal by any standard. The FBI should name the persons who set this up and who has taken funds from it. Since Ms Ford is a principal figure in this, she should be investigated and interrogated thoroughly. It all smells to high heaven. The timing, the choice of lawyers, the gaps in her charges, etc., etc.. How can this not happen in the name of fairness which the Libs claim is a must? I find writing this stuff to be therapeutic. jack

    Leland Keyser's lawyer stated Keyser believes Ford's account but that Keyser doesn't know Kavanaugh and has never been at any gathering with Kavenaugh, including the one Ford alleged in her testimony.

    So what Keyser is stating, is she has no memory of Ford ditching her so she was all alone in a house with three 17 year old football players, who were drinking.

    Keyser has no memory of being left with an extremely drunk Kavanaugh, who Ford alleges had just tried to rape her!

    Keyser has no memory of the police or the person Ford had take her home, knock on the door of the house to rescue Keyser from dangerous drunk, sexually assauling boys Ford had just escaped.

    If Ford's story is true, it appears Ford had no concern that the dangerous boys she left Keyser with, might assault her best friend also.

    What 15 year old girl would not remember her best friend ditching her and and leaving her alone in a house with predatory drunk 17 year old football players?

    Keyser says she has no memory of it ever happening or ever meeting Kavanaugh because the most plausible explanation is she never met Kavanaugh or attended a gathering like the one Ford alleges.

    I wish that somehow we could find a way to send every voting citizen of this country a picture of all the men in the Democrat party that have miss treated women. Start with JFK and Marilyn Monroe, LBJ and his escapades, Clinton and his treatment of women and let us not forget the Kennedy that left a women to drown and still served in the Senate and tried to run for president. We need to jog the memories and let the young people who did not live during those times just how rotten this party treats women. Also, I have observed over my 71 years that once you are rich you become a big old hateful liberal that thinks the workers should pay for everything and they are damn happy to give our money away to anyone, just so it isn't their money. We the People that carry the load are really fed up with Washington and all it represents.

    I think you're the best and most sensible politician ( and probably regular guy) that I pay attention to. I'm pretty selective about who I pay attention to. I'd vote for you if you run for president again. In fact, I'd probably try to help out on your campaign if you needed a guy on the ground here in Idaho. But, I couldn't be a source of personal funding for you because I give my extra money (what little there is) to my church.

    It has been said that Judge Kavanaugh was out of control with his anger. I believe he has every right to be angry and what I observed was that he exercised anger under control at that ridiculous hearing. The liberals really need to take a look at video footage of their anger expressed throughout these hearings, actually throughout the past 2 years, to see what anger out of control looks like. Do you think they have been blinded, deceived, by Satan, and they really can't see the truth or do they know what they are doing?

    I have to differ with Mrs. Crouse, not to argue that many people we're praying all week, but that no one seemed to believe Kavenaugh's
    accuser. All the Dems, especially the women did believe her, and apparently the men, although they had predetermined they wouldn't vote for him, simply because Trump appointed him, and they all hate Trump. I could see Hillary's hand all over this.. her attorneys represented the accuser. Why would they do Ford's case pro Bono? She's not an indigent. They were working for Hillary and the DNC to derail the appointment of Trump's pick. Can we trust the FBI with this investigation? I guess that remains to be seen, but I wouldn't bet on it. That's something we all need to pray about. Thank you Mike Huckabee for telling it like it is.

    I recently saw, for the first time, the 45-point Communist manifesto describing how to convert a country to communism. It reads like a leftist playbook. If you, Sean Hannity and others would somehow get this info out there quickly, before the election, it seems that many independents and maybe moderate Dems would realize where the Left is trying to take us, and vote conservative in November. At the very least it might be a wake-up call to comatose Republicans to get out and vote! Thanks for all you do. God bless you.
