The Kate Steinle Verdict

I returned home from dinner last night to hear the jury verdict in the Kate Steinle murder case and the comments of Garcia Zarate’s defense lawyer Matt Gonzalez, and I can tell you it didn’t make my dinner set well.

I was stunned and furious about this blatant miscarriage of justice and the arrogant, misleading exploitation of the Steinle family’s grief by the grandstanding attorney. Gonzalez had spent weeks insisting that this had nothing to do with politics or immigration, then the second his patently guilty client was freed, he ran to the nearest camera to politicize Kate Steinle’s death, outrageously compare the murder prosecution of his criminal illegal alien client to the kangaroo Russian collusion investigation of President Trump’s campaign, and depict the attempt to bring the Steinle family some long-delayed justice as racism against immigrants and the verdict as a victory for immigrants’ rights.

And when he insincerely added that he offered his “sincere condolences to the Steinle family...I hope that they do not interpret this verdict as diminishing in any way the awful tragedy that occurred that their family has suffered,” I just about threw a lamp through my TV screen.

Frankly, I was so furious that I didn’t how I was going to write about this. I felt like just typing “Grrr!” and holding down the “r” key for about 500 lines.

Fortunately, I had the rest of the evening to calm down, read a lot of other analysts and think it over. I also had the dignified example of the Steinle family, who said they were “saddened and shocked” by the verdict, but not surprised. Her father Jim said, “Justice was rendered, but it was not served.” They refused to attend the verdict announcement. Her brother Brad owns a gun, but he said the vast majority of San Francisco jurors have never even fired a gun and don’t know that it's "ridiculous" to claim that they go off by themselves. He called the trial the “least important part of the puzzle,” saying he was just flabbergasted by the “epic failure” of the entire system that culminated in a multiple-deportee criminal being freed onto the streets. Plus the fact that even in light of his sister's death, local politicians doubled-down on their sanctuary policies, and nothing has changed.

Taking the Steinle family’s stoic example, I know you depend on me to give you a perspective based in common sense and facts, not just partisan spin or emotion. So I’m going to try to keep this as dispassionate as I can.

First of all, in an attempt to give the jury the benefit of the doubt that they aren’t necessarily the worst murder trial jury since O.J., there is a good article at RedState.com by Sarah Rumpf. She examines what the jury heard and explains some mistakes prosecutors made that might have caused jurors to feel there was reasonable doubt (for instance, doubting that the gun was fired deliberately, or thinking that because the bullet ricocheted before striking Kate, that he didn’t mean to hit her.) Those things might be loopholes for escaping a murder charge, but they don’t explain why they found him not guilty of nearly every other lesser crime (even involuntary manslaughter), finding him guilty only of being in possession of an illegal firearm. And maybe the jury would have had less doubt if the judge had allowed them to hear such irrelevant details as Zarate’s prior felony record or that he’d been deported back to Mexico and returned illegally five times.

It’s a conviction that could bring him three years in jail, although the DOJ seems to be leaning toward immediate deportation (yeah, that works with him.) A reminder: when Southern juries used to acquit Klansmen who lynched innocent people, the DOJ stepped in with federal charges for depriving the victims of their civil rights. But I’m not a legal expert, so I’ll just throw that out there for others to debate.

Not surprisingly, the verdict was roundly condemned, even by some Democrats. It also sparked a flurry of furious Trump tweets, with the President calling it a travesty that proves we need to “BUILD THE WALL!” I have a feeling it will have more than a few people suggesting we build a wall around San Francisco.

Seen in that light, maybe some good will eventually come from it, if it shines a harsh spotlight on the deadly reality of allowing cities and states to thumb their noses at federal law and create protected classes of criminals at the expense of their own citizens’ safety.

I will also console myself with the thought that the infuriating, misleading and self-righteous comments of attorney Matt Gonzalez will backfire bigly. He employed several of the left’s cherished tropes, including trying to redefine terms (i.e., the way “liberals” morphed into “progressives” after the utter failure of their ideas became so undeniable that the term “liberal” became toxic to voters.) Gonzalez tried peddling the canard that calling for enforcement of border security and longstanding laws passed by bipartisan Congresses is somehow an attack on “immigrants.”

News flash: your client is NOT an “immigrant.” He is a repeat criminal illegal alien. They are two very different things. You can hide his record and status from the jury, but you can’t hide the facts from the public. Calling him an “immigrant” who deserves the same rights as a legal US citizen is a slap in the face not only to the Steinle family and the US system of law, but to every legal immigrant in America who waited in line, followed the rules and obeys the laws of their adopted home.

The deliberate conflating of “immigrants” and “illegal aliens” has been one of the most potent weapons of the left in falsely tarring Americans as bigots for simply wanting immigration laws enforced. Maybe hearing that argument made so blatantly under such shocking circumstances, and seeing the tragedy and injustice that disregard for the law has led to, will finally expose how phony it is and destroy it as a useful propaganda tool.

Maybe that post-trial speech will end up being the catalyst that finally unites Americans to get serious about enforcing border security and immigration laws. And when we do build that border wall, maybe we should name it after Matt Gonzalez.

    I agree with you 100% Mike. Your comment about maybe San Francisco needing a wall around it, I agree. I am a native Californian and so were my parents. California was a magnificent jewel among these united states. San Francisco was the crown jewel. Now it is just trash. What a waste. What a shame.

    When I heard the verdict in this case I was horrified, disappointed and furious! God bless the Steinle family and the beautiful young woman whose life was taken so abruptly. I cry out to God "WHY" to so many things everyday in our country....heartbreaking for me, who grew up in the fifties and sixties, to experience the madness of our world this day and time.

Trump should call for the Garcia verdict to end any political delays in building the Wall, to kill the illegal DACA Executive Order debate, and loudly nail the Dems with any Govt. shutdown plans--plus then use VP Pence and 51 votes to prevent it. (2) As soon as the tax bill passes before Christmas, Trump should appoint all of his judicial nominees during recess and "allow" McConnell to have the Senate confirm them as soon as recess is over by ignoring the home state Senator "blue slip" courtesy delays. (3) AG Jeff Sessions should remove his recusal on Hillary as he was allowed to speak his thoughts as a citizen, and must PROSECUTE his larger duty as AG NOW, due to the preponderance of evidence of illegal activity in her campaign, emails, and foreign contributions, etc. I agree with his position to assign Federal DA's to convene Grand Juries to investigate the Uranium Deal as this is faster than a Special Prosecutor--but immediately and include Mueller and his Deputy FBI guy now on helping him prosecute in the people being investigated for burying their investigation on Russian bribery to get the uranium deal.     I think it would be worth knowing about the punishments for shooting a seal off a pier at Fisherman's Wharf in San Francisco. It would be interesting to know how fatal harm to a mammal in California would sit in relation to the verdict for Kate Steinle. We know there is a discrepancy when animal cruelty laws are placed alongside the killing of an unborn child by abortion. I love animals, mammals, etc., and support their protection. However, would the defendant have received a harsher punishment had he killed a seal as he supposedly intended?

    I could not agree with you more. I was so ANGRY with the verdict that I could have screamed. I have two daughters age 39 and 36 and empathized his Kate's Dad. I do not think I could have been as composed as he has been. When I heard the verdict I contacted the San Franciso Public Defenders Office and sent them an email of displeasure ( I did have to revise it multiple times to omit all profanity ) and asked them how they could justify the verdict but I do not expect to hear back from them. I am sure they were patting themselves on the back. This past Saturday I watched Judge Jeanine with her take on the verdict ( who was right on target ) and I got angry again so I emailed the Mayor of San Francisco asking him how he thinks this will effect tourism. I indicated to him that San Fransisco is currently 5.4 BILLION in debt and has the 5th worst Tax burden per resident in the country. I politely asked if he could quantify the economic impact of this ( since he is Mayor this should be very important to him) but once again I don't expect an answer. I must tell you Mike that you are the calming voice of reason but are not afraid to call a spade a spade. I supported you for President and still believe you would have done a great job and it is enlightning to see your daughter as the Press Secretary as she is doing a fantastic job ( guess she had a good teacher). That's my two cents.

    When I watched and heard the verdict, I immediately saw red. I thought for sure we would finally get some justice, and immigration laws may actually be enforced. I took an oath when I went in the USAF and I don't think I would do it again at this point. I'm embarrassed by the manipulation of our courts and the entire operation of the federal government. This is not the country I swore to defend. Liberals have me sickened, and fed up to the point of considering retiring outside the USA. If Lois Learner get her testimony sealed, it will be the last straw for me, I'll sell my business and leave.

    I am not surprised at all by this verdict. I have lived in the S.F. Bay Area all of my life. It is difficult to get a guilty verdict in the courts in this area, especially when it comes to illegal aliens. I have often wondered why we even have a court system here.

    Sometime ago I read a good comparison made by someone else. An assailant in your home is no more a member of your family than an illegal is a member of your country (citizen/resident/immigrant). When my liberal relatives bring that the US was formed of immigrants, I always tell them that illegals are not immigrants and make them picture an assailant in their own homes. Do they call police? Then they would have to call ICE for illegals, too. They still don't get it; unless fate brings them to a reality check through events. It is sad.

    Excellent commentary.
    The far-left cancer that is debilitating basic 'law and order' must be confronted, and prosecuted. People, call, write and/or e-mail your congressman and Senators and demand that Mr. Sessions and the DOJ immediately file suit for 'criminal charges' against all mayors, D.A.'s and law enforcement that refuse to uphold federal immigration law. Their crime? The complete distain of federal immigration law and their violation of their oath to uphold our Constitution.
    Get a few (many) of these Anti-American values politicians 'locked-up' may bring about some compliance to our properly legislated laws.

I really enjoy watching your show and it is one of the most worthwhile programs aired. NFL is no competition!     The 'verdict: Just UNbelievable... The judge should've rejected the jurors verdict and tell these folks to 'think again', (keeping in mind the guys repeated offenses). Shame on that judge for accepting such a verdict. Don't these people take oaths? To the sanctity of life, fair trial & serve justice? At a minimum offense this court broke its oath--
    too bad all that protocol was a charade. Seems to appears as 'kangaroo court' as politics rule the day!
    As it stands NO justice for this young lady ...seems to be a common outcome in today's America... i.e: Benghazi!

    Mike, I spoke yesterday with Chris, who served in the Coast Guard roughly a decade ago. He couldn't believe that the jury was gullible enough to believe that the .40 caliber handgun accidentally fired all by itself. His opinion was that Jose Ines Garcia Zarate pulled the trigger. That is a conscious act. I think if this trial had been held in "Fly-Over Country," where I'm from originally, the verdict would have been very different. It is indeed a travesty—a mockery of justice. Kudos to the DOJ for pursuing federal charges. I see that #BoycottCalifornia is now trending on Twitter. You can understand why! California, the "Sanctuary State," is embarrassing itself with its blatant defiance of law in terms of compliance, enforcement, and prosecution. (David E. Miller, Las Vegas, NV)

    Dear Gov Huckabee, Thanks so much for y our comments. I agree w/ you one hundred percent!! I feel so sorry for Kate's family and I cried when I heard the verdict. My tears are also for America. I'm 85 year old great grandma and have seen many horrible (and wonderful) things in my life time. My concern is for my little great grandchildren who will never grow u p in a country as great as we had!! I believe we have been on a slippery slope since prayer and Bible reading were removed from the classroom. When that happened I didn't say much and when abortion happened I didn't say much either. So in some ways I blame myself for what has happened to America. So I am glad Pres Trump in in the White House (although I would have liked you to be) and God is using him to change our country but it is so far down that slope to destruction only God can save us now.     I look forward to reading your insightful and sometimes comical comments. In this case there was NOTHING to make light of & like you I felt speechless. I was beside myself with outrage upon hearing the verdict of illegal alien Zarate and felt a depth of sadness for the Steinle family that made me sick to my stomach. My reaction afterward was the thought, "Why should I be surprised?". We are living in a time where "right is wrong and wrong is right". Thankfully we can "up" and take courage and hope.

    First, California should be removed (forced secession) from the U.S. by vote of the People of the rest of the states. There is no hope of it ever changing course and becoming sane again. After one calendar year, a border wall should be built between it and the rest of the states. I am sure the remaining useful idiots would gladly agree to add a few hundred billion to there ballooning debt and pay half the cost to accomplish the feat. It would not take long for the new asylum to be the pariah of the planet. There is nothing there that cannot be recreated elsewhere in the remaining 49. As it currently stands, it is a open wound that is infecting the rest of our once GREAT nation. Without the U.S. taxpayers subsidizing it, California would slip into a place that ANYONE with money would do ANYTHING to escape or at least start building walls within walls to protect themselves from the "masses" they so wanted to allow accross their borders. When your body has a vile cancer that is invading the healthy body, you cut the disease away and try to save the whole. The cancer is spreading and the future is plan to see. What California once was is no more.

    Thank God that our Attorney General has filed new charges that, hopefully, will keep this person in jail until he is an old man, then he can be sent back to Mexico. Praying for the Steinle family. This is every bit as bad as the outcome of the OJ trial. Justice has not been served in either one. Maybe we should give California back to Mexico!

    "Zarate was found guilty of possession of a firearm by a felon and is expected to be deported." That won't do a bit of good. He has already been deported numerous times for numerous FELONIES and he keeps returning. This guy even gives illegal aliens a bad name!! The gun fired itself??? That is a first!! He fired the gun. He pulled the trigger. He was in possession of the gun! Was the jury filled with mentally ill Liberals?? That must have been the only reason he was not convicted. Countless eye witnesses, possession of the firearm, etc. It was a case full of evidence of his guilt but he is an illegal alien in liberal California. I wish they would disengage themselves from the USA and float off toward Hawaii!!

    I too nearly threw up when I heard that verdict and then heard that a-hole of attorney's comments. It seems the inmates are leading the honest institutions - (can't remember the correct quote) but you know what I mean I'm sure. I hope some good comes of all the reaction to this verdict - her father put it very well. Can something be done to get rid of "sanctuary" cities and how they protect illegals, criminals in the name of "protecting" innocent children who were brought over by parents to take advantage of our country and its soft hearted (and sometimes soft headed) laws?

    I applaud you for your clear thinking and always read your articles - thank you for being a voice for those of us who don't have a public platform.

    There are few - very few - voices that speak so truthfully and eloquently these days and you are right at the top of the list (I kinda rock back and forth between you and Newt). I read all of your posts, if for no other reason than to find that I'm not crazy. As a matter of fact, your reporting strengthens me. I have a pretty analytical mind.....I recognize and I stand on truth which I think is my gift from the Holy Spirit. I think the characteristics that disgust me most are lying, laziness, and ignorance. The Steinle fiasco is just beyond the pale. He must be brought up on other charges and sent back to Mexico. I hate to think the American taxpayers will be forced to support him. We must build that wall to keep people like him out of this country. John McCain: who got to him and/or what was the purpose of his holdout? He's so enigmatic and divisive......and caused so much pain. When are we going to see Hillary get justice? When one looks at the whole picture in Washington, it almost appears insurmountable.....the dissention, the corruption, Obama interjecting his presence into everything, Hillary's smugly insisting she is still relevant...etc., etc. I read you every day.....just had to contribute some kind of "thank you."

    I agree, Gov., but I think there is an underlying conspiracy here, in which some Mexicans see the US as part of Mexico, and that we are illegal immigrants. And by them coming up here from Mexico, they are coming into what they feel is THEIR LAND, and they are taking it back from the invading population. To the illegal whose illegally obtained firearm, who supposedly tried to shoot at something, whose bullet 'ricocheted' and struck Kate Stienle, he felt vindication for his illegal venture, his SIXTH, onto our land, yet Kate Stienle can not rest in peace, because he was let off the hook, with help from a liberal Hispanic attorney, by a liberal California judicial system. It sounds crazy, coming from a conservative black man.

    I am so grieved. The "government" took God out of schools and now we have an immoral, insensitive, diabolical population. How on earth could anyone who values life decide in acquittal for that evil man? That needless life would not have been taken if the people respected and obeyed the laws of this land. He should NEVER have been in this country at all.
    I can't imagine the grief and devastation that family must feel now.
    If a huge earthquake slides the coast of CA into the ocean, I will think and say that most of them have earned that.
    Our Justice system is no longer justice when that evil man gets no accountability nor consequences for his action. God Help Us. This is so wrong it defies human decency.

    I am shocked at the verdict but not completely surprised. Why, because the trial was held in California and in my opinion we should kick California out of the union. They, most of the people that live there, are off the wall. They don't care about our country, don't care about people, only themselves, don;t care about our history (want to rewrite it) and don't know what love and respect are all about. I won't go to California and don't want to meet people from there and we have a lot that have moved to Jackson, WY. We have got to do something about the liberal left and the Democrats in order to save the United States. I'm just very depressed at what is happening to my world but more importantly what will be left for my granddaughters. This is a VERY SAD situation. Thank you Mike for what you try to do. Robin L

    If you will recall, the murderer of the late Rabbi Meir Kahane, was also found not guilty by a NYC, jury despite a mass of evidence including eye witness statements. The DOJ then stepped in and brought charges against the killer as it pertained to violation of Rabbi Kahane's civil rights. The killer was found guilty and was sentenced to a long period of incarceration. Why not take this course of action now?

    This will now solidify the resolve of Americans to strengthen our borders and rid our country of illegal aliens once and for all!
    We should take EVERY measure possible to find them, root them out and remove them. Not only build the wall but secure it with lethal force!!
    If you want to come in, apply like every other LEGAL immigrant. Forget about only the "criminals one" they are all criminals as they broke our laws by crossing the border!

    How would this event have morphed into a political spin if Pellosi would have been the victim on that San Fransisco street, that day, at that time? Would an all Democrat jury arrive at the same verdict?
    I hope Mr. Stienle has an acquaintance or two in
    Mexico to greet the killer as he crosses the border! Mexican justice is more swift, I'm sure!

    I wonder if a bill could be put forth in Congress that would allow our country to separate us from California? This would save the rest of us billions of dollars and allow California to exist however they want. They wouldn't be encumbered with our Constitution or laws and could make up their own PC laws. They could even go back to Mexico and be just as broke as they are.
