Judge makes good call; rest of Steele/FBI records coming out

The FBI has been put on notice to get moving and finally hand over some long-awaited documents, thanks to yet another Freedom Of Information Act lawsuit by Judicial Watch.

U.S. District Court Judge Christopher Cooper apparently has had enough of their stalling. On Friday, he ordered the FBI to conduct a search within 60 days for communications with British ex-spy Christopher Steele (whose name is on the phony Trump “dossier”) that –- importantly –- took place AFTER Steele was officially let go as a confidential source right before the presidential election.

Let’s go back and look at this chronologically. Documents obtained by Judicial Watch in this lawsuit had already shown that the FBI paid Steele at least 11 times before firing him for leaking to the media. But that's where the trail ended.  JW was still seeking all the records of communications between anyone with the FBI and Chris Steele and/or his firm, Orbis Business Intelligence, that occurred after Steele was fired. This would also include any records related to any meetings or phone calls between any representative of the FBI and Chris Steele and/or any representative of Orbis. JW also requested all records related to “the proposed, planned, or actual payment of any funds to Mr. Steele and/or Orbis”; it’s not known if the payments JW knows about are all that were made.  (Steele seems to have had a talent for getting paid by multiple clients for essentially the same work.)

The Justice Department at first refused to produce these documents in response to JW’s March 8, 2017, request. In fact, they shrouded their refusal in fog, saying they could “neither confirm nor deny the existence of records responsive to [Judicial Watch’s] request.” Believe it or not, they argued that since the records covered a period when Steele was no longer contracted with them, they were concerned about violating his privacy (!!!). The court initially sided with the DOJ (!!!).

But it wasn’t over. On March 26 of the following year (these things stretch on forever), records were declassified that provided evidence of Steele’s role as an FBI informant and his firing in November of 2016. When Judicial Watch saw those, they asked the court to re-open the case, and the court agreed, as the FBI continued its refusal to search for the records.

According to FOX News’ Catherine Herridge, Judge Cooper ruled in favor of Judicial Watch, saying the records should be made public because the Steele allegations targeted a political campaign. He wrote that “those records might either bolster or weaken Steele’s credibility as a source. That information, in turn, could provide a basis on which to evaluate the FBI’s performance of its law-enforcement duties, including its judgment in selecting and relying on confidential sources, especially in connection with such a politically sensitive subject. 

Indeed. No wonder the FBI was fighting so hard to keep them secret.

Judge Cooper weighed Steele’s privacy concerns against the public interest and wisely found the public interest outweighed them. Since in Steele’s case, disclosure would not have made his affiliation with law enforcement public for the first time –- we already knew about that –- the judge thought the balance tilted in favor of disclosure. Thank you, Judge Cooper, as it seems increasingly hard to find a judge who will look at the big picture and not just at what will hurt or favor the President.

That the FBI is still protecting Christopher Steele this late in the game is raising suspicions with Tom Fitton, president of Judicial Watch. The swamp continues to push back. Obviously, the Bureau will hold out as long as it can –- and, keep in mind, this is happening under the leadership of current FBI Director Christopher Wray. Bureaucrats.

If you aren’t reading Andrew C. McCarthy’s just-released book, BALL OF COLLUSION, I hope you will be soon. You’ll find it both comprehensive and comprehensible. McCarthy bravely makes the case that this spying operation had to be directed from the top down. The VERY top.

Consistent with that, here’s how he put it on Monday morning’s “FOX & Friends”: “The Obama administration put the law enforcement and intelligence apparatus of our government in the service of the Clinton campaign. Counterintelligence investigations belong to the President --- they’re only done for one reason, and that is to gather intelligence so that the President can carry out his national security responsibilities under the Constitution. So any counterintelligence investigation is the President’s investigation...It goes to the President.”

Recall the intriguing reference in the Strzok-Page texts to the President wanting to know everything they were doing.

Anyway, McCarthy lays out the case, and, knowing him, it is solid. If Obama did direct or even have knowledge of this activity on the part of the FBI (and, it increasingly appears, the CIA, with Brennan as the mastermind), and we had found out about it while he was still in the White House, THAT would have been grounds for one heck of an impeachment, let me tell you. Not a fantasy impeachment over made-up crimes, but a real impeachment over disgusting “high crimes” that actually were committed. As I’ve said before, this stuff makes Nixon look like an underachiever.

    I would like to see something happen, but there have been documents and information that was to be made public. AND it has not. Just like the IG report, incriminating report on many and they will be recommended for prosecution! NOT! Where is it? NADA The first IG report......NADA. It is a waste of time, and nothing will happen. The criminals will walk, and the likes of Flynn and Manafort will be pay the price. I hope I am wrong, but we do have a two tiered justice system!

    IMO, the FBI, DOJ are pulling a good ol' hilary tactic. Put the JW or even the AG, etc off long enough to give them enough to destroy documents--if they haven't already.

    There are those loud speaking democrats who are determined that, if we don't get Trump impeached, hung for treason, or whatever they can come up with--they will, by golly go after him after his term(s.) Of course, they are working for one term--I'm thinking it will be 2. After he is no longer a sitting President, they will go after him with all guns blazing. Now, can't the same be said for obama? If he is found to be complicit in the meddling with the 2016 elections, can't he be hung out to dry for that? Or, is it only a former Republican President who can go to prison? Since there is so much double standard. Come to think of it, guess slick willie could also come under fire for any part he took in the meddling?

    Keep in mind that when you read of a really stupid so-called research conclusion that the research was most likely paid for with federal tax derived dollars. Federal government funded research must pass a political test in order to receive the funds. Remember the guy who first publicly said the Earth is round? He was placed under house arrest for the rest of his life. Those who ignore he lessons of history are doomed to repeat them.

    I am afraid I somewhat disagree with you comment about the media not fooling anyone. From listening to my friends the media has convinced them that a recession is coming, even though the analysts say that it is unlikely in this country. They predict a slowdown, not a recession in this country. They do predict a recession for ?Germany and possibly Britain because of .brexit. Consumer sentiment and people’s attitudes about investing can cause a recession. The media so wants a recession, enter heat a depression. That way they can get rid of POTUS and get their “life/planet savers” in. They care only about that, not the welfare of most people. We must look after our poor, but we should not do it at the expense of most other people by making life equally miserable for them. Talk about selfish, racist people and I do not mean most conservatives.

    On another point, it is very hard to actually access the true state of climate change when we cannot seem to have rational discussions. I am always wary of dire warnings. Let’s have some real and truly scientific discussions. We can, and have, cut our emissions, but if the rest of the world, like
    China and India do not do the same it will not make a lot of impact. That does not mean I do not support working to improve the environment. Anybody been to Beijing or Cairo lately???

    there are FAR too many suspicious things going on. Wray is covering up for Steele, really? What's Wray hiding? why is it that no one wants us to look at the period March to July 30 2016? HUH! Halper, Mifsud, why was an Australian diplomat telling the FBI ANYTHING? Who ELSE in MI5,6 was involved in spying on Trump? There are far too many things going on that never should have. Some people around Barry had BETTER hang for sedition an treason. This is NOT an option. Strok, page, Hilary, Barry and Steele didn't want DT to be elected. Mueller and Weismann wanted to remove him from office. And then there is Comey, Brennan and Clapper. OMW what a bunch of crooks! But they are FAR worse. Yes, Nixon is looking like an amateur right now in comparison. Well, really there IS no comparison. A KNOWN communist in the CIA, a KNOWN communist as Sec of State, a KNOW communist as prez? Really? Tom Clancy would have a field day with this! Except there is high suspicion that barry had him murdered.

    Mike we count on you and your team daily to untangle the truth from lies that surround us. The way the media works with some unscrupulous govt traitors these days reminds me of the accounts of Egypt fighting Israel on 6- day war, losing and then confusing their Arab Muslim citizens with concoctions of reality! (See Nonie Darwish’s book “ Now They Call Me Infidel”). Yours is a voice we need to hear.

    If Obama does get implicated, and better yet indicted, that should force to opening of his sealed records. School, marriage etc. I am from Chicago. Spent a lot of time at the U of C. Obama is not exactly who he claims to be. The biggest fraud perpetuated on this Nation. If he is found to be corrupt and indicted maybe we will get to the bottom of his history and those who supported it.

    The actions by the FBI and CIA are beyond pathetic. I agree, underachiever for Nixon is a great label. I don't recall any government activities more despicable in my lifetime. Nothing. It is fraudulent, dishonest, and there are no real words for what it looks like took place. It appears they literally tried to cheat their way into office and tried to frame the freely elected President & removed when they didn't win. I have nothing but disgust for the democratic party anymore. And I was raised a major democrat.

    It has seemed to me for a long time that Obama not only knew what the FBI and CIA were doing -- he was directing them to spy on Trump's campaign. Personally, I think it goes even higher. I think Obama was a puppet for other resources. I also found it interesting that Hilliary (spelling intended) looked so frightened when she was conceding to Trump. What and who was she scared of -- and why? I only hope that the truth comes out while I'm still alive. Thanks for your interesting and well-written articles!

    Thank you, Judge Cooper, for your common sense decision to force the FBI to search for and release the Steele communication with FBI. The depth of the corruption and cover up is breathtaking. And Thank GOD for Judicial Watch for doing this hard work using FOIA laws in the courts.

    I think everyone pretty much assumes that Obama was behind this. He wanted Hillary Clinton to win the election in order to carry on his legacy. The real Russian collusion can be attributed to the Clinton campaign, the Deep State, and the White House. If the full details of this conspiracy are revealed by summer of next year, President Trump's reelection will be a shoo-in, and the "legacy" of Barack Obama will be that of a dark stain on our country's history. As for Hillary Clinton, she will finally...finally!...be disgraced in full.

    Well, students, what you see is a victim of TDS in this slide. At first the disease manifests as bizarre behavior, screaming at the sky, accusing everyone of invading their safe space, and other harmless such oddities. That is quickly followed by secondary stages of hallucinations involving people in fur hats who say “Da” a lot and then sheeted evildoers appear everywhere. These hallucinations add to the patients’ insanity and lead them to the final stages of the disease in which they cut off their noses to spite their faces, shoot themselves in the foot, and suffer knee-jerk reactions that plant their feet in their mouths, sometimes even both feet! This disease has been classified under the general umbrella of Terminally Stupid. Sadly, as of this writing, there is no cure. Class dismissed.

    Why aren't more Republicans more vocal and taking action about these serious crimes committed by Democrats? Why do we only hear from a handful including Lindsay Graham, Devin Nunes, Matt Getz, Liz Cheney, Jim Jordan, Mark Meadows??? We need to elect really strong Republicans who will support President Trump.
