Lots of breaking news on Mueller overreach

April 12, 2018

On Wednesday, a day of significant breaking news about what looks to be blatant overreach on the part of Mueller’s team, I appeared on Shannon Bream’s late-night show on FOX News –- having knocked back a couple of Red Bulls first –- to talk about some of it. I made the point that nothing about the special counsel’s tactics is surprising, given what we already knew.

In America, we don’t go breaking down doors, raiding someone’s home and taking personal papers and computers, as was done to the reportedly cooperative Trump attorney Michael Cohen, just to learn more about a questionable campaign contribution. This was clearly an enormous stretch of the law, an intrusion on attorney-client privilege committed for the purpose of intimidating the President and his attorney. Here, a law professor and former chairman of the Federal Election Commission explains why…

This kind of behavior violates Americans’ sense of equal justice for all. Did anyone raid Cheryl Mills’ house? No, by all appearances she was treated with kid gloves and was even allowed to ASSERT attorney-client privilege in the Hillary Clinton email case, though she herself was a witness in that case. And, gosh, was Hillary’s home in Chappaqua ever raided, or the offices of the Clinton Global Initiative? They were under scrutiny (supposedly) by the FBI, but nothing close to that ever happened.

As for the theory that Mueller pulled that stunt to bait President Trump into firing him, I made that same observation myself soon after the raids were conducted, but it should be noted that neither Trump nor his staff has said he was going to do that. Acknowledging the power to fire Mueller is a long way from actually firing him. Trump surely knows the political and legal firestorm that ousting Mueller would create, no matter how richly deserved (for Mueller) and personally gratifying (for Trump) that firing might be.

But Democrats and the media (but I repeat myself) have created this narrative. It’s laughable that Congress is actually talking about passing legislation to protect Mueller’s investigation. As I told Shannon, I’m much more concerned with who’s going to protect this great republic of ours, the principle of separation of powers and the integrity of the office of the Presidency. Who’s going to protect Americans like you and me from the intrusion of federal agencies busting into our homes (or the offices of our attorneys) just to see what they can find? If they can do this to the President of the United States, you and I have no hope whatsoever of protection under the Constitution.

As I said, today was full of breaking news on this whole mess. As reported by Ed Henry, one source who saw the search warrants used for the raid on Michael Cohen’s office, home and hotel room described the real goal as a “search and destroy mission” against Trump personally. Apparently, they wanted to find out more about the Access Hollywood tape, specifically whether there were other attempted payoffs during the 2016 campaign. Payoffs to whom –- RUSSIANS?? What does any of this have to do with the assignment given to this special counsel, which was to investigate possible Russian collusion with the Trump campaign or other Russian interference in our elections?

The continued employment of Attorney General-in-name-only Jeff Sessions and Deputy Attorney General Rod Rosenstein is another matter. President Trump is justifiably furious that Sessions took his job only to recuse himself from all things Russia; Trump would certainly have appointed someone else if he’d known this might happen. Rosenstein should have recused himself from the investigation at the start because he wrote the memo for Trump arguing for Comey’s firing and also because he approved at least one FISA application renewal for the warrant to spy on Carter Page. His failure to recuse seems to me to be a cut-and-dried firing offense.

Commentary continues below advertisement

Oh, and it finally happened: the minimally-unredacted FISA application from July 2016 –- the one that set the FBI’s Russia probe in motion –- was finally, finally seen by chairman of the House Intelligence Committee Devin Nunes, along with Trey Gowdy and committee staffers, after threats of contempt of Congress and possible impeachment proceedings against FBI Director Christopher Wray. Wow, it’s amazing the way threatening impeachment can move things along; they actually got to go to see Rod Rosenstein and read the two-page document, the one said to have been “significantly” written by infamous anti-Trump FBI official and compulsive tweeter Peter Strzok –- who, incredibly, does still have his security clearance, as we also finally learned today.

I would like to know why Mueller is permitted to waste tax dollars in this manner (actions that appear to be a witch hunt by deep state?) My second question is if Mueller has stated that there is no evidence of Trump's collusion with Russia which was the purpose of the congressional investigation from the on set, why is this organization still in operation? Further since there is no relation between Daniel’s and Russian collusion What gives the congressional investigation right to secure a search warrant in the irrelevant Daniel’s situation? Obviously that should have been denied. An overreach this apparent deep state operation has taken upon itself to extend it's purpose into other areas, sort of a self appointed policing that is insuring revenue for an operation and its constituents that should have been annulled long ago. They have exceeded their grounds of authority to the point of creating a possible tyranny where rights are not protected. Mueller and his team are committing disastrous actions that impedes our current government and established laws that protect the citizenry.

I am sickened by this outrageous turn of events - as you point out either way its going to be a mess. Mueller must obviously see himself as a Jury and judge with the ends justifying the means, with no, no, concern for the country itself or the Constitution. H ow was he granted such broad powers and is there no way to curtail them? Since he has jeopardized us by this precedent - could not Congress or the Supreme Court limit his investigation or admissible evidence, etc.? Why do we have these august bodies if not to control and protect our citizens and see justice done? This is a travesty. If President Trump colluded which I very much doubt, then this is a great tragedy - if this is allowed to continue unhindered then we are in danger of becoming like the Nazis - we do not need that - try thinking a little bit outside the box, think about what is at stake - appoint someone to oversee Mueller's team and use your powers wisely for once. Shame on you for allowing this

    Hi Mike,

I've suggested this before but I'll mention it again with the current news that some in the House want Paul Ryan to step down as Speaker immediately and not wait until the end of the year when he retires.

Newt Ginrich, in my opinion, should return as Speaker. It is NOT necessary that the Speaker be a sitting Rep according to the Constitution. One only needs a majority vote of the House. Hopefully President Trump could persuade them to pull that off.

    Thanks,
    Rose Howell

P.S. YAY for Devin Nunes! Gowdy for Attorney General?

This whole political garbage is a joke on we the people. Trump is no better then the rest. He is not doing anything to help stop the left from running this country. They are still running the US 100%. What a joke this is and always will be.

I don't think President Trump should fire Muller because it would be worse for him. Someone should fire Rosenburg or whatever his name is and Sessions should do his job and fire Muller. I watch your show on TBN. I use to watch the one you had on Fox. I am for President Trump and appalled at what is being done to him and his family. I believe that God chose him to be our President at this time, to save the United States.

I absolutely fed up with this relentless attack on President Trump! With all the existing, known incriminating evidence against the previous FBI and DOJ leadership under Obama WHY aren't they being prosecuted? What in the world is Sessions doing?! This nation pays all attention to illegals, criminals, minorities and basically ignores the law abiding majority until they want your vote. Fire Rosenstein, fire Mueller and let's get on with replacing traitorous politicians with representatives who will WORK to make America Great AGAIN!

It is amazing just how far people will go when they are desperate, they will do any thing and say any thing to get what they want. The democrat's are so desperate to get Mr. Trump out of office, only God knows how far they will go. Keep up the good writing Mr. Huckbee, and God bless you and your family.

What is the worst agenda in the USA "Justice Dept" ; with a leader who is a member of the
President's Official Cabinet : To have an Attorney General who is a criminal boss with rigid
allegiance to the Commander-in-chief and anti-American Constitution, as Lynch and Holder
were for Obama and Clinton; OR to have an A.G. like Jeff Sessions who was advised by
"never Trump" haters to recuse himself in January 2017 from ever being involved in any
Justice activity related to Russian innuendos or the DimDem 2016 Clinton defeat ?

It is way past time to put a stop to all this nonsense , we the people are all sick and tired of all the b.s. that is going on ,if the so called "Leaders " of our great Nation would spend even half the time on making things right and good for the country as they do fighting among them selves this would be one hell of a Great America again. We all would like to see justice done without double standards, we all know that there is documented prove of the illegal acts done by the Clintons and Obama and yet to see any justice, but are President that was VOTED in by the people can not even go to the bathroom to please the Dems, or lefts ,or what ever you want to call those crooked thieves. If they don't think it will end in a civil war they are badly mistaken.Someone in Washington needs to grow a set and stand up for the people and make things right, for it still is a Government of the people for the people

Gov. Huck it seems that CONGRESS has turned a Blind to the Special Counsel trashing of AMERICA'S CONSTITUTION. The new Law that is being written #specialcounselintegrityact must be passed by CONGRESS. Dear Governor, I couldn't agree more. This double-standard has got to be squashed now. It is dangerous for our Republic. Number one, where are the checks and balances? Mueller went far and above the investigation into collusion especially when the details of the corruption by Hillary Clinton, her campaign, DNC and top officials of the FBI and Justice Dept. are available. Mueller is obviously, common sense, trying to force any little thing he can twist to charge Trump with a charge to impeach him and hopefully remove him from office. This is impeding the job of the President of the United States and the great constitutional policies and agenda he has been advancing. I facetiously joke "is there a Clinton Mafia" who is threatening him or have all the players of the Deep State ganged up on Mueller, Rosenstein and Wray that they have no choice but to go after Trump like he was Jack the Ripper? This is unprecedented and certainly exhibits an image of divide and chaos in our government and country. That plays into the hands of our enemies! Sessions needs to go as he is not either doing his job or someone has something on him. We need someone to head the Justice Dept who is not politically biased and who can not be manipulated or pushed around! Heads need to roll so we can put a stop to this corruption and prevent it in the future. Again, where are the checks and balances? Mueller is like a chain that has come off the spokes of a bike. Nothing is out of reach for him.

"In America, we don’t go breaking down doors, raiding someone’s home and taking personal papers and computers, as was done to the reportedly cooperative Trump attorney Michael Cohen, just to learn more about a questionable campaign contribution." You are correct. We go to court and present enough probably cause (of a crime) information that a Federal Judge issues a search warrant.

Robert Mueller has definitely overreached! Trump can legally fire him but he must not. He should do something about Jeff Sessions however. Unless Mr. Sessions decides to do his job, and fire Rosenstein, and Mueller. He is basically worthless and getting paid for it. A waste of our tax dollars.

  • Lawrence E. Foster

    04/12/2018 02:38 PM

Mueller is no stranger to fabricated evidence.

If I hear one more Clinton Cartel Spokesweasel lisp a paean to the 'honesty and integrity' of Bobby Mueller, I will barf! and if i am close enough, I'll barf all over the spokesweasel.

Mueller was Assistant US Attorney, then US Attorney in Boston when the FBI was"running" Mafia leader Whitey Bulger as an informant (although it turned out later, Bulger was running his FBI handler, John Connolly (Connolly eventually was convicted of accepting bribes from Bulger, and went to prison.)

Unlike the intelligence community, where supervisors don't want to know the identity of human sources, the US attorney has to go before a judge to get subpoenas, and no US attorney would do so without knowing who the key informants of the FBI are. Bulger, and a close lieutenant of his named Steve Flemmi were both "informants" for the FBI, and the FBI protected them from prosecution.

When a minor Mafioso hoodlum named Teddy Deegan was murdered (by Steve Flemmi's bother, Jimmy - on Bulger's orders), rather than go after the killer - which would have resulted in them going after Bulger - the FBI went after four minor mafioso figures. They concealed evidence which would have exonerated the men, and for the next few years when the men came up for parole, Mueller sent letters to the parole board which exaggerated their roles in the Boston Mafia in order to keep them in jail. The FBI - in the form of Bulger's corrupt handler John Connolly (and his equally corrupt supervisor John Morris) personally went to a member of the parole board, and threatened him to try and get him to vote against parole. The FBI intimidation continued when the parole board member became may or Waltham, Massachusetts.

Eventually, the convictions of all four mafiosi were overturned. It was too late for two of the men, however, who died in prison. There was a hundred-million dollar settlement with the men and their families, which we, the tax payers paid.

There are two possibilities concerning Mueller's knowledge of the FBI's frame-up of the four men. As the US attorney for Massachusetts, either Mueller knew what the FBI had done to railroad the four junior mafiosi, and supported the FBI's efforts - or he was bone stupid. (One cannot discount the possibility both are true).

At the end of the day, I suspect we will find that long before Bobby Mueller was publicly picked to be the 'special counsel', James Comey, Rod Rosenstein and Bobby Mueller "colluded" (to use a favorite democrat word) and came up with the plan to intimidate Jeff Sessions into recusing himself, then having Rosenstein appoint Mueller to be the Clinton Cartel's Torquemada. Whether other members of the "deep (as in cess-pool deep) state" (e.g. Jim Clapper, John Brennan) are involved will come out eventually.

So, when you hear Weasel Blitzer intone his praise of Mueller's "reputation for integrity", remember the two innocent men who died in prison at Mueller's hands, and the $100 Million settlement we the taxpayers had to pay out. Remember the two FBI agents (Connolly and his supervisor John Morris) who were convicted of accepting bribes from Mafiosi - while Mueller was the US attorney in Massachusetts. Mueller's hands were not clean before he was appointed, and he continues to run roughshod over civil rights in the same way he did in Massachusetts.

If there was ever a case for firing Mueller, this is it.

I am greatly concerned for our nation as I watch the Constitution being shredded, laws being ignored for some while being feverishly enacted for others! I am just an ordinary citizen, but it is clear as can be that the Deep State (left overs from the obama administration and GOP rinos) is committed to tearing this country apart and bringing down President Trump and this Constitutional Republic. I am appalled at the actions of Jeff Sessions, Lyndsey Graham, and others of the Trump administration who are standing by and simply watching our President being falsely accused day after day after day! I don't understand why (the left, at least) thinks it okay to raid Cohen's premises, and Manafort's, yet people stood by with their fingers in the ears (or in their eyes) while hilary stalled providing what had been subpoenaed, until she had the time and opportunity to destroy a major amount of that. And, why people are standing by, waiting for FBI, DOJ to produced documents that have been subpoenaed--and, so, they gave up (some) documents--want to bet it's just a minute amount--and, give them the time destroy documents? Hey, it worked for hilary!!! Something's fishy here. Raid the FBI and DOJ departments (oh, wait, FBI is who usually does the raiding!) using whatever means necessary--with all agents and top dogs banned from the site until the raid is complete and they can't take anything to hide/destroy. Oh, and better make it a surprise raid--2 or 4 in the am would work.

Being a resident of the State of Missouri, I am doubly troubled and yes, mad as hell, at what is happening at both the federal and state level. We have a Governor who is being railroaded by Dems and now Republican'ts. I won't go into details but just to say it is a Soros funded event, and when state law enforcement didn't find any evidence of wrong doing by the Governor, the District Attorney (of course a democrat woman in St. Louis) hired private investigators to dig up dirt on the Governor. She seems to have the same authority that Mueller has investigating President Trump.

Governor Huckabee, surely there is someone in leadership that can do more than talk about the destruction of our constitution, country and our rights to freedom. We all talk about this atrocity but nobody does anything. NOw it appears the republican'ts would rather resign and not run again rather than stick their necks out and address this problem by representing us, the voters, who are livid at what is happening.

    Gov. Huckabee--
Thank you for your newletters and tv interviews. They're great! I believe that the reason the New York judge/court was involved was to transfer all of Trump-Cohen personal information to the AG of New York. That AG has filed cases against Trump and Trump family before Trump became President. Just a ploy. Also when I heard that the FEC was involved, I believed that Eric Holder and Obama had something to do with this (Dinesh D'Souza's jail time was because of FEC violation).

It is said that absolute power corrupts and that power corrupts absolutely. No truer words have been spoken by man. A great many in Washington, D.C. have either forgotten or never acknowledged that The Most High God will exact His will upon all people and their willingness to cheat the people whom have entrusted them to govern properly shows they have no fear of a righteous God. I pray for them, that they come to a realization of what they are doing before it's too late. I just keep thinking about what God's word says. Paul wrote to the Galatians this in Chapter 6:7. "Do not be deceived, God is not mocked; for whatever a man sows, that he will also reap". I am not saying I'm Mr. perfect. Far from it. There is a price to pay, though, for trying to deceive and cheat and they certainly do not have to worry about someone like me to exact payment for their ways. I only have to allow God's will to be accomplished. I pray not for their destruction but for their heart to change. It is sad, really, to watch them destroy themselves this way.

We've watched the Mueller fiasco for over a year. The amount of money spent by we the people on Mueller and his team is a waste. The worst part of this is that there seems no way to stop what he's doing namely breaking into homes and other similar actions. They do that in communist and dictator countries. How do we get rid of Mueller and fast? His task; Russia, Russia. He's way beyond that and destroying the lives of Americans in the process. We should turn the same actions his way to find his collusion and other deeds and hold him accountable.

Once again governor you are on spot. But you along with everyone else are missing the whole story of the swamp. The deep state is there to stay. I hate making this reference, but the deep state are the brown shirts of the Democratic party. They, like the Democratic party will do anything to survive and to win. All along the democrats have presented our DULY ELECTED PRESIDENT DONALD TRUMP as the villain. With the deep state to help them along with the leaks, the slow pace of FOIA requests, they obstruction of justice on their side and the slanderest media on their side. The deep state also has help from the RINOS and non of these people care who knows their real intent. They will eventually find something on Trump, maybe a bunch of unpaid parking tickets, they are desperate for anything. One last point to make, first to go will be the second amendment, then the first. This is the price people will pay for re electing the same idiots every two and six years

Mullers actions are scary and the Liberals reactions to it are also. They do not seem to realize how it is affecting. . all our freedoms. Praying for our country.
